    Don't worry, this sounds like just the standard defence banks file.

    Basically they are saying that you knew what the charges were and that you would get them so that justifies them levying them against you.

    But as Martin has said, just because someone who punches you in the face tells you they're going to do it first, it doesn't make it right.

    Just wait now, as they have defended you will get a court date and no doubt like thousands of others you will get a payout just before it goes to court. (Don't expect that to be soon though it may be a couple of months)

    call your credit card company, tell them that you want to leave, 99% of the time theyll lower your APR%

    I have noticed while reading this thread that when someone wants to reclaim around £5000 + Abbey (or should i say Shabbey) tends to pay them a small fee (£300-£400) but when someone just wants £400 or less even they don't seem to budge. I reckon this has something to do with when i heard sometime ago from someone that if an account holder with abbey has lets say around £15k + in there savings account and they go over in their account they don't tend to be charged. Whilst as for some others (like myself) who doesn't even have a savings account for the moment gets charged £30 a go. There reason? They reckon that people with less money in their accounts are less likely to move banks and will just pay up and shut up.

    I want to reclaim £300 and i've only sent them the 2nd letter two days ago and to be honest after reading most of this thread i going to threaten them with court action right now!

    your probably right and your very right about doing the court thing now. as they wont budge for nothing. And dont settle for less coz I wont be as I have sent 3 letters and have phoned them various times and they aint having non of it. to court date it is.

    I've received 1 yr of statements so far, still wating for the rest, but will stick to the timetable with the shabbey. But I've notice a £10 miscellneous credit has appreared in my account yesterday. Do you think they have refunded my £10 for the 6yr's worth of statements? Anyone else had this?
  • Hi, I wrote to Abbey recently asking for my 6yrs worth or statements, they replied but, they only sent me 2006 and so far of 2007. These were summary statements rather than the ordinary monthly type. Clearly as you can see they havn't sent me the other 4 yrs - Help! What can I/ should i do to get them?

  • Hi all,

    I asked abbey on Jan 11th for information on charges as per martins templates. A month later I got a reply with the cheque back as my address had changed, they asked me to change address and re-submit (that took them a month), I did that and resent the letter early feb also complaining at the length of time they had taken to respond in the first instance and demanding action. As yet i have received NOTHING! I called them about 4 weeks ago and they said it was being processed and had been requested 22 feb but could take six weeks. It is way over the 40 days but i see that lots of people have problems with abbey, can someone please advise me on next stage - directions to the relevant section of the information Commisioner site or a template letter would be fantastic.     I have now written my next letter giving them 14 days before legal action.

    Did you win your claim even though they had sent you the letter advising that their fees were legal?

    Unfortunately, i've a feeling that Abbey may be playing unfair...

    Got about 50 pages of "microfiche" that do not show any charges... Though for some reason - the dates of the transactions are sometimes not in order, and i appear to have debits for "interest debit" which i assume is interest charged while i was overdrawn -though have no "fees" shown anywhere, ever.

    Has anyone else found this... My thinking is that they have failed to answer my access request within 40 days - but i can't progress a claim as i have no idea what i should be claiming....!

  • I’ve just received a three page defence from the Abbey in response to my claim for the return of £50.00 charges plus court costs.

    What do I do now?
