    Before I filed my court papers, Abbey credited my account with a goodwill gesture of £370.00, after claiming, inc interest £810.00
    I sent them a letter saying I would not accept it and wanted the £810.00 in full. ps it's still in my account.
    I then used MCOL claiming £810.00 thinking Abbey would honour my letter and remove this so called (gesture) of £370.00.
    Am now confused as to what to do if it goes to court, is this ok, as I have copies of letters and proof of postage.
    Hope someone can help.:confused:

    I'm in the same position with MBNA. I claimed £2121, they sent a "goodwill gesture" of £870 but I declined it before they sent the cheque. They sent it anyway so I cashed it!

    I've started the MCOL form filling it out but I don't know whether to include the £870 or not and do I charge the 8% interest from the first charge or work out when £870 would have been charged and work the interest out from that point onwards.

    Also hoping someone can help.
  • Hi Brickie,

    The interest is worked out at 8% APR on each charge from the date that Shabbey nicked the cash off you to the date that you completed the Calculator. So tell them that's how you worked it out.

    ss1973, I don't know about the interest part, but you cannot claim for money you have received so you can't include the £870.

    Have put that and sent the letter off recorded today with a list of the charges and a copy of the previous letter i sent accepting the offer of £120 without prejudice and as a partial payment, and also a small letter sayinf exactly what you recommended.

    Now i'll have to wait and see what happens next!

    I haven't included the £870 and I've just submitted my claim only calculating the interest after taking off £870 from the charges.
