Hi all, I'm new to the site and I need some advice please!
I'm pursuing bank charges from Abbey. I received a response to my second letter (from Martin's template) to which they replied that they did not agree with my request for £1,006 and proceeded to put £80 worth of unfair bank charges back into my account which they thought was reasonble!
I was not happy with this so I then sent them the third letter threatening court action and asking for a reply within 7 days. They have replied this morning saying they are dealing with my request but that this may take up to 4 weeks (which is also the same letter I received in response to my first letter!). My question is should I wait the 4 weeks for their next response or take the matter further and proceed with court action straight away?0 -

I received a copy of Abbey's defence in the post today. They basicly say i knew terms and conditions, the charges are not penalties and they are proportionate to Abbeys loss of me going over my agreed overdraft. But then i think they go on to say ( i've read it 20 times but still a bit confused), that even if they are not proportionate i remain liable to pay such fees as may be found proportionate.
so really they are saying they are a true cost then if they are found to be too much i must deduct the difference?They also say that i am not entitled to interest and i have not provided admissions for the amounts claimed. But i have sent the schedule of charges about 3 times now
Whats next? all advice greatly appreciated0 -
Sorry this will have been covered earlier on this thread but there is sooo much to read.
I'm totalling my charges and wondering wheather to send them to my local branch or is better to go to a central station somewhere, would it be ok to include an article about why the charges are unfair so to avoid them replying about the usual terms and con-ditions.0 -
I sent a stage 4 letter off to abbey refusing their pitiful offer of £680 settlement ( this is not even a quarter of the claim) But before a cheque for the £680 settlement has just arrived. I've written to abbey telling them that this is not acceptable . But what should I do With the cheque ? Also Today i just recieved a letter from them saying that they are sorry I'm still not satisfied with there offer . and that they will need a further 4 weeks to look into the case : again . I have only allowed them 14 days What should I do .Who can help:rotfl::rotfl:0

You can write and advise them that you will accept the £680 as partial settlement without prejudice and will continue to reclaim the remainder. You can set your own time period for a response to this but I would allow at least 7 days. From then, depending on if they offer full settlement, you can continue to court. Good luck0 -

Hell yeah include that article!! Let's them know we're on to them!! Send it to:

Bradford
BD1 5ZJ
and please make sure that you go to the post office and send it recorded for an extra 68p, that way you have proof that it has been received by abbey and proof that you gave them more than enough time to resolve this matter.

Well I've set my spreadsheet with all the charges then used martins calculation sheet to work interest out and to make sure my spreadsheet was accurate. I've sent that along with a letter and gave them 14 days, it's taken me a fair few hours(work time) to get this all together. Just got to go to the post office and get it sent recorded
