    all you need to say is the interest is statutory interest worked out from the day you were charged to the date that you worked out the calculator, as it says just above where the article is that explains what your entitled to but dont forget you arent entitled to it unless you win in court.
    I have received copy of the defense and then a futher letter asking me how I came to working out the interest etc. I merely used Martin Lewis template on the interest etc so im a little confused as to what to write back or do I just send a copy of the amounts with the dates I am claiming and the interest amount. Would someone mind explaining this to me if they have been through this - thank you

    yes you can claim them back. below is a list of charges you can and cannot claim:-

    CAN BE CLAIMED

    Account misuse fee
    Cheque return fee
    Card misuse fee
    Unarranged borrowing fee
    Unauthorised overdraft fee
    Unpaid DD fee
    Unpaid cheque fee
    Unpaid standing order fee
    Late payment fee (credit cards, store cards, catalogues etc)
    Exceeding Authorised Overdraft Limit
    Exceeding Unauthorised Overdraft Limit
    Direct Debit/Standing Order/Cheque returned fee
    Irregular fee
    Paid refferal fee
    Total charges (HSBC personal accounts only, not business accounts)

    CANNOT BE CLAIMED

    Cash Machine Withdrawl Fees
    Account Service Charges
    Service Fee / Annual Fee
    Charges related to foreign currency transactions and conversions.
    Monthly account fees on certain type of accounts.
    Normal overdraft interest charges

    When I sent my 14 day letter to HSBC, I forgot that part of the 14 days would be the Easter break.

    So I am in same dilemma, do I wait 14 'working' days or normal days - part of me thinks 'working' days, but then I think about letters I have had from the bank, stating that they need a response within x days or further action will be taken - there is no differentiation between working and normal days then.

    So if I don't receive a reply by Friday 13th (ooer,:eek: perhaps ought to wait till Monday 16th) then I'll be first in the queue on MCOL!

    Can anyone help clear something up.

    I sent my first letter in to Abbey instructing I want nearly £5.5K in bank charges refunded to me due to them being unlawful.
    I thought If i played fair when it came to court if it got that far they would see I was not impatient and gave them plenty of opportunity.
    Anyway, un be known to me, they have refunded £235 to my account today and sent out a letter saying I accepted this!
    I argued with the woman on the phone and she said, the money refunded to your account is standard procedure if you want to decline this and go for the rest you can do this but you will have to wait for the letter.
    I am so annoyed.
    When I sent in my first letter to them I instructed I wanted a full refund and gave a complete breakdown of what was owed by them to me including interest.
    My question is this, Do I return the money to bank?
    What does this really mean? Am I entitled to all of my money back or is this all I can have?
    What is my next step or course of action?

    Stick to the steps set out on this site. Write them telling them you do not accept this payment as a settlement and they should remove it from your account. They are hoping your desperate and this measley sum will buy you off.
    Stick to YOUR timescale. Dont take ANY bull. DONT be intimidated. The law is on OUR side.

    But what does them giving me this ammount mean?
    Does it mean I am onto a winner?
    Do I give back the bank the money they have deposited?

    Hi all, I had a joint account (with my husband) with the abbey. (eventually closed by Abbey, but it was cleared)

    Would a claim for charges have to be done jointly, or can i just do it on behalf of us both?
    It was an account where either of us could sign.

    (OH knows nothing about any charges).

    You have as much chance as the rest of us. Dont draw the money. Write to ask them to remove it and stick to your timescale for claiming.
    Stick to YOUR timescale. Dont take ANY bull. DONT be intimidated. The law is on OUR side.

    To nursegladys and treasureirealnds if what they are doing is illegal, then let the court decide. Yes you knew the terms and conditions but 1. You do not have any choice other than to accept them and 2. They are illegal. I read somewhere on here that in one success story the court ruled that £2 was a reasonable charge. So £2 was deducted from each charge. So you would be paid out your total - minus £2 for each charge. Also can you ever tell the Bank they are not entitled to interest ? No! They just take it! The thing is do not let Abbey bully you as well as nicking your money. Hope this helps a little bit.
