Thanks for that bit of info, I was going to send in my letter today. So all I will say is that I accecpt the money you have paid into my account as part payment without prejudice and intend to proceed through to the court within the next 7 days if I do not hear back from you about the remainder of what you owe. I must warn you if I have to take this step that the ammount will rise as court costs and days lost income will also be included to the ammount.
I wouldn't claim lost income either. It's probably not worth it. You would need to provide additional evidence of lost income and prove it due to bank charges. Not straightforward.0 -

Have just had a notice of issue from the court, it says that if shabbey does not file an admission, defence or counterclaim, or if the defendant admits the whole claim with or without an offer of payment, i can ask for judgment. What is a judgment??0 -
I have just had a chat with the Abbey customer complaints they have told me they are going send my complaint up to the next level. I have told them I will be forwarding a letter to them also in connection with the telephone call stating that I am not happy with the £235 they have paid into my account, which I add I did not agree to at any given time, for my claim of £5,300 bank charges and asked for them to remove this but they have advised they cannot do this. I am also giving them 7 days to look into my claim or i will take the next step of taking them to court.
Next step counting the days. I hand my letter in to them by hand today. I allow for bank holiday. So they have till week Monday to come back with response. If nothing back from them I issue court proceedings on the Tuesday! I am already signed up and ready to go!0 -

I have taken Abbey to court.
They are defending the case. Today I received their defence that they are going to produce in court. Just kept rehashing the same sentence. That I knew about the bank charges that would be applicable if I go into unauthorised overdraft. And yes they have sent me 'The Leaflet' many times.
Anybody can advise me please do.

well even if they say you signed to open the account that you agreed to the charges then, the rule still stands, that penalty charges must reflect administration costs and if the charges are higher than those costs then the original terms and conditions are null and void. the T&C's would be illegal in the principle that it is illegal to make a contract with someone if any of the terms are unlawful in any way.0 -

the judgement will enable you to claim the full amount plus the interest on top. if they still dont pay up you'll be entitled to send in the bailiffs, which is good news in a way. how long did the courts say they had to file defence etc?0 -

the courts have given them till the 24 april,and then fingers crossed i might get some money back!!

Hello,
I am trying to reclaim bank charges from the Abbey, they have so far only sent copies of 1 years statements but nothing for the other 5. I have also found a couple of my original statements and there are charges on them that do not appear on the duplicate ones. Does anyone have any advice what course of action I should take to obtain the other five years copy statements and what to do about the charges they are not disclosing.

I have been watching the forums closely. I have requested money back from 3 abbey accounts and 2 barclays.
Barclays
Account 1 - reclaim £200, offered £190 (accepted)
Account 2 - reclaim £250, second letter been sent
Abbey
Account 1 - £672 exc interest - offered £40 (not accepted - going to court)
Account 2 - £199 exc interest - offered 0 -not accepted liability (not accepted - going to court)
Account 2 - £180 exc interest, second letter sent heard nothing so far.
Well it looks like we are defiinitely going to court over 2 Abbey accounts and possibly number 3 also. I can't believe that they have offered £40 and saying as everyone else has said that we "signed up to the terms and conditions" when we opened up the account and that the costs are for the extra administration that has to happen due to going overdrawn etc.
Will let you know. Will be filing for court over the bank holiday.
