    I have recently sent off request for charges from Halifax which I got back - I had to send details to them to prove my address as I had moved since I had the account with them

    2nd letter I sent requesting the charges back (letter sent to my local branch) I had a reply firstly stating 40 days - er no read my letter my terms are 14 days but they have requested mmy to fill out a change of address form, but I originaly filled this out when i sent my first letter to Abbey H/Q as they wanted proof/confirmation of address change - Do I still fill this out or shall I just send back stating 14 days or court action???

    miss bonkers: they'll more than likely file a defence in the last week or use the loophole saying they missed it and ask for more time to prepare a defence

    The story so far
    Amount Claimed £1040 plus interest
    As I had all of my statements sent first letter 14/3/07
    Rec'd bog standard reply dated 19/3/07 Sorry you're unhappy looking into it will be in touch.
    Sent LBA letter 28/3/07
    5/4/07 Mysterious payments appear on balance slip go to Abbey Cashpoint print off Mini Statement which shows ten refund charges, no letters, no phone calls.
    7/4/7 Two letters in the post today from Abbey
    First Letter dated 2/4/07 addressed to my Wife referring to her letter of 1/3/07 ? they have carried out a full investigation, sorry she was unhappy, Charges were correct, gesture of goodwill will refund £100 into joint account in next 10working days
    Second Letter Addressed to me contains final code to access on line statements
    On line statement shows Sixteen Miscellaneous Fee refunds
    Two were for Unauthorised Overdraft Fees x £20
    Two were for Cleared Transactions x £30
    Twelve were for Unpaid Direct Debit Charges x £35
    Grand Total £520 Great News we're having a good Easter with our Money that the Abbey Easter Bunny has unearthed.
    So far Abbey have paid exactly half of my claim which we are delighted with but I still want the other half of our money.
    I would welcome others thoughts on how to proceed next ?.
    Wait to see if more is credited after the holiday,Telephone, Write without prejudice accepting refunds as part settlement ?
    Also although they have stated the charges were correct and do not contravene the Unfair Terms in Consumer Contracts Regulations 1999 have they not by itemising the refunded amounts individually tacitly acknowledged
    that the charges are indeed unfair and in contravention of the Act ?

    No, they are gestures of good will, I would be amazed if the bank made any sort of admission otherwise.

    Not quite sure on what to do (regarding what others do), but I would personally write a letter saying (along the lines of) ....

    Thank you for the £520 refund regarding my claim of £1040 (plus interest). I will however still be claiming the remaining money from you .... blah blah blah

    Then procede to the next stage as if they hadn't paid you anything, just change the amount that you are claiming.

    Hope this is the right advice to give, its what I would do.

    Send a copy of your change of address form but remind them they are still under your 14 day timescale. If they dont respond or try to stall, send the 7 day final demand...Stick to your timescale not theirs! Good Luck

    I sent the original letter at the end of February and the statements came in batches on a daily basis, but only a one financial year back. I have only one original to compare and that has over £200 worth of bank charges that do not appear on the duplicate.

    Haven't had any other correspondence from Abbey since and have had another £200 worth of charges from my account since.

    I have done all the things that this site has suggested, and am claiming back £2,750 from The Abbey.

    I got their standard letter about two weeks ago, and gave them 14days before taking court action.

    Their time is up, I have heard nothing.
    So, i am doing the online court route.

    Costs £120, but If I win, I get it back I hope.

    Question is...After I click 'Send' to the court...what is the usual timescale?

    The bank have 14 days to respond...should they say they intend to defend they get a furthur 14 days (ie 28 days from date servrd with claim). Then they either pay or defend. Its hard to put a time on it but you will know more in 28 days from service. Good Luck
