You could always follow up the letter with a phone call saying what you have done. I doubt Abbey would settle anyway. It's not their style?0

Did you carry on straight to the courts or give them so many days to repsond before applying through the courts?0

I filed my claim against the Abbey on MCOL on 30/03 for £4800 and on checking my account today I see that they have refunded some charges totalling £995. I have not received any correspendence from them explaining what this is.
My question is should I inform MCOL of this and should I be writing to the Abbey requesting that they take it back as I want to carry on for the full amount. Is there a letter template on this site for this ... Ive been trawling through different threads but couldnt find one.
Thanks to all for the help and encouragement so far... couldnt have done it without you.

I read if they've given some charges back that you can ring up the MCOL and ask them to change the amount your claiming. As said I read this and only yesterday some where in this forum."I AM THE GATEKEEPER OF MY OWN DESTINY" Nacho Libre

Thank you for all the help. I have drafted a letter to send in to them tomorrow stating that I accept the ammount they paid into my account without prejudice However I intend to apply to the courts within 7 days if I do not hear from them in relation to the rest of the ammount of £5,250.00 which is still outstanding and owed to me by yourselves.
I do however wish it to be known that I do accept that I should pay for some of the costs when these charges occured onto my account and I will agree to the standard ammount of £2.50 per transaction totalling £405.00 to deducted from the ammount of claim as total costs incurred by Abbey.
I look forward to your reply with 7 days or I shall have alternative but to proceed through the courts which will also incurr extra charges to be added to the ammount due by yourselves for court costs and loss of earnings due to myself having to take the day off work in order to proceed with this matter further.
Do you think I have said everything that needs to be said ok? or should I change some of the wording? Any replies would be greatly appreciated.
DO NOT SAY THAT YOU AGREE TO THE CHARGES, even if it is a lower rate. as they will use it against you and you will more than likely lose your case. all your saying is that you accept the amount as partial payment but you will be pursuing for the remainder of the balance thru your county court.0 -

What if the bank has paid some money into your account but with no letter of explanation... I intend to let MCOL know but not sure what I should put in a letter to the Abbey.
Thanks

MATE!!! Do not admit that you should pay any charges!! Take that bit out, if you are to pay any part of the £30 charge let the court decied that. Keep tight lipped!!0 -

Thanks for that bit of info, I was going to send in my letter today. So all I will say is that I accecpt the money you have paid into my account as part payment without prejudice and intend to proceed through to the court within the next 7 days if I do not hear back from you about the remainder of what you owe. I must warn you if I have to take this step that the ammount will rise as court costs and days lost income will also be included to the ammount.0
