i would say that £5 is a bit steep i deducted £2.50 which a judge in a court case agreed with so i went along with it in my claim..............since you've filed your claim already did you mention the £5 in you'r particulars of claims section?
if not and since your claim is for £2000 i wouldn't bother,when it comes to settle you can negotiate then.
the £50 GOGW letter you can use in your court bundle

I don't think you should have agreed to the bank that you would be prepaired to pay a charge and then volunteer a price for a charge, this way you are admitting that the charges they have imposses on you are lawful and that you agree to charges, I don't think it will help your case, and that's why they have given you a meesley £50 gogw.

I have been trying to claim from Abbey for a few months now and have been checking this board reguarly and have a few tips for ya!!
Abbey WILL delay things as long as possilbe!!!
They WILL send letter stating that they will be looking in to your complaint, They WILL send another letter advising that it will take another 4 weeks!!!
How long does did it take you to work out your charges when Abbey finally sent you all your statements? Was it 4 weeks?? Was it 8 weeks?? NO it was an hour or so! So it does not take Abbey 8 weeks plus to work all this out, they already have the information there!!
My advice is to ignore all the "we're looking into it" letters and stick to your time frame of 14 days!!! DO NOT wait for Abbey!! You are the boss!!
By giving them 14 days to sort things out, this proves to the Courts that you have given Abbey sufficent time to deal with your case, and that they haven't provided you with a satisfactory response.
STICK TO THE 14 DAYS!!!!
Please send eveything recorded delivery, costs 68p and gives you peice of mind and proof of when they have received your letters!!
If your account gets credited with a "good will gesture" keep it!! Write them a letter headed "Without prejudice" and thank them for this payment but now you will be going to court to to claim the rest, as stated in your previous letter. This good will gesture that they have payed into your account will help you pay the MOL fees!! So why not use their money against them??
I have read that some people have written to Abbey agreeing to pay a small fee for each charge, please do not do this as it's basically agreeing that you agree there should be a charge and are willing to pay a portion of it, I thought the whole idea of this is that we are claiming the charges as unlawful!!

Have just heard the 9 o clock news on Radio 5 live. Abbey are sending out letters to all people claiming money back, citing the case where the claimant lost his case a couple of weeks ago. This is as a warning to us all, to put us off. They are the only bank doing it.
Didn't take them eight weeks to do this did it?
So put your armour on and sheild yourself from their slings and arrows of bullying and scare tactics.0 -
the whole point about the charges issue is the amount of the charge.............and centres around when a charge becomes a penalty, i decided to go down the £2.50 issue when i first started my claim based that you don't get nothing for free and also was a morale one for me...........my claim as it stands now amounts to £6000+ and the £2.50 which didn't hugely dent my total charges amounts to £605 so when SHabbey Irational comes calling and they will! my claim will be settled in full and no less (i will see to that), they'll also claim that "you will have to pay some amount of charges" and i'll reply that i have as a GOGW already deducted a fair amount as in respect of their costs per charge and that it's up to them to disclose these to prove otherwise.
i'm not advocating that other people should go down this route it was my choice and everyone has their own way of recovering their charges .............follow the steps correctly and your own timescales and and be prepared and everyone wins.
regarding the GOGW amounts people receive...........there is no set formula that Shabby sticks to...........it's a random plucked out of the air amount....i received £446, lots of received twice the amount for smaller claims.............lots have received nothing at all.

Firstly, huge thanks to all the information on the the site, it has helped me out no end in getting to where I am now in my claim against Abbey.
However, it's now been passed to the local court and I'm awaiting contact from them.
I've already downloaded the claim bundle and I was after advise as to whether I should add a specific personal situation in as something I'm using in the case.
In the defence that Abbey have filed (which seems like a default template defence) they state (amongst many things about T&C's) -
"The Claimant's contention that the said fees are unenforceable and/or are "penalty charges" is denied. The fees reflect and are proportionate to the Defendant's administrative expenses incurred due to the Claimant's breach of contract and are a genuine pre-estimate of the damage suffered by the Defendant."
I had a situation on the account where I used a debit card four times on one day (ranging from £6.65 to £17.40 and totalling £53.05) which put the account over the overdraft limit and I was charged £30 for each transaction plus £20 for being in an unauthorised overdraft.
Should I quote this as an argument against their charges being proportionate or am I likely to be shot down in flames!?

Just opened up my post this morning and got a nice letter from SHABBEY...basically telling me that I am not putting enough money into my account. Does this have to do with the fact that I have moved all my money to another bank just so i do not face charges?? I THINK SO...
Will send a nice curt reply to Mr Allen Betts who says
The overdraft limit and the special facilities for graduates including the interest free limit, were granted based on the value of regular credits made to your account
Note:
1) I am not a graduate
2) Up till last month everything went thro my abbey account: wages, student loan, phone bill,
3) I went over my overdraft so the cash point chewed up my card and now they refuse to give me a new one...
4) They think I care if they threaten me - now im gonna take them to court all they way...
Oh yeah and
Information on how you conduct your account will be shared with credit reference agencies on a monthly basis. This will include the fact that you are not maintaining the agreed credits to your account!!!
the cheek...not once have i seen on my experian file that abbey have said "this customer does not put enough money in his account"...
time to write a nice reply to Mr. Betts.Scrimping and saving!0 -
just got off the phone to abbey reg:: my charges...spoke to a guy who said
"due to the increase media limelight that banks are facing and the increase in demand, we require upto 8 weeks to process any response. what you will get is a standard template letter in 4 weeks saying we need another 4 weeks because we have to do this. I have just had a lady who's case has lasted 14 weeks and she was shouting her head off. If yours takes longer than 8 weeks I advise you to take the legal route!"
can you believe it?? they are admitting they won't pay, they can't cope with all their angry customers trying to get their money back and are advising us to take legal action...
well i think ill just do that...thank you abbey !!

i have today at last had enough money to issue my online claim against abbey i was just interested to know if many have been successful i am claiming almost 4 grand back off them should have done it a month ago but couldnt afford it was hoping they would pay up before then but they never i probably would not have done this had i not read the support letters on this site thanks for giving me the push to go through with it . all i gotta do now is nervously wait and see what happens i will keep you informed: :0

I'm in the same boat as you mate.
I'm going to have a look at the mcol site in a few minutes,but i thought i'd have a read on here first to see how everyone else is getting along so far.
At this stage im not sure what to do. The last letter i sent to shabby was by recorded post and was ignored (4weeks ago now) so i know they got it !!!
Now its court time.0
