Hi everyone, i sent off my letter claiming my penalties back last week and today recieved a letter from Abbey stating they are pleased to ofer me a £1400 overdraft it i wanted it - was just wondering if anyone else has ever received that?

Its a delaying tactic, just send off the next letter as normal. The one saying that you havent had a satisfactory response.
You'll find it under Martins section on reclaiming bank charges, i thinkits letter 3 or 4.

I am in proccess of helping my daughter claim charges from Abbey, we have statement with the most recent (03 to date) with accompying letter saying been that if the account was opened before this date another statement will follow, this was over a week ago, the 40 days is up on the 14th June, is this common practise?What we see depends mainly on what we look for

Been trying to get charges back from Abbey since 1/2/07. After lots of letters with delaying tactics I eventually issued the summons. They had until tomorrow to decide how they would play it and I have received from the court a form to the effect that ABBEY will be defending and are asking for 28 days to get their case together.
What I will say is that I sent them a letter early April stating that I wish to reclaim 2 grand apporoximately but I would deduct £5 per transaction to acknowledge that there is a charge that I am accepting. In answer to this they wrote back stating they were going to pay me £50 as a goodwill gesture and they would put it into my bank in the next few days. As we were on holiday in France over Easter, I was not able to reply to this by declining their kind offer and found on return that indeed £20 and £30 had been put into the account. I wrote further explaining that I had not agreed to this 'goodwill gesture' and that I would also deduct £50 from the total that I am claiming through the courts.
Does anybody out there think I might be on better or worse ground as I have accepted £5 per transaction and so have basically said I appreciate they do have to charge. ?
The offer of £50 was in a letter that I would have thought would have been headed up with 'WITHOUT PREJUDICE' but it wasnt - could this have any bearing on the case at all ?
So, now I am waiting for a court date !!

Hi, just wondering if anyone could tell me if it would be possible to combine the first two template letters into one, i.e. state that i will begin court proceedings in the first letter if they do not refund the charges within the 14 days?
any thoughts anyone?

Im am in the final stages of claiming against Abbey, I have sent the 3 rd letter telling them that i will be taking them to court if they do not pay back the charges against my account. They have until wednesday 23rd when i will start procedings against them! Its all very exciting :j .
Just a point of interest - when i claimed for the list of bank charges , they sent me all the statments from when the account was opened, and two days after, I received the £10 cheque back with a letter stating that abbey does not charge for this service. I thought that was very sweet of them! :rotfl: The bad news is that since starting my claim they have made charges against my account for a further £134.00, I will wait till my claim has been settled then ask for the £134.00 back , and if they say no will do the process all over again! I have decided not to use direct debits anymore and am now using payslips and payment cards to pay all bills, I cant cope with bank accounts, never could never will. another point of interest - when i went to open a parachutte account, the bank employee who opened my new account said he was in the process of claiming back the charges his own bank made against his account, I pointed out that the bank might get stroppy and sack him , he said he didnt care. How cool is that!?!?0 -
Saul169, you may find that when you receive the offer money you will have to sign a form agreeing that you won't ask for any further charges to be refunded so the £134.00 you may never actually see.0

What stage are you at? Have you sent a letter before Court action? If yo have then the next step would be to take them to court.0 -

if the last letter you sent abbey was the threatening them with court letter the next stage is to take them to court. i believe there is 2 ways to do this.
no1. N1 form which you can download and take to your nearest court and No. 2 is the mcol which is all done on line. what ever way you do it i wish you the best of luck.0
