Hi,
Not been on here for a while as i am at the stage where i am just waiting for a court date.
does anybody know how long it usually takes to get a date? As i have phoned them twice and the lady there said that my case was passed to the judge on the 2nd May and to just sit and wait now for them to get in touch.
Anyone know how long i should expect to wait?
also, does anyone know where i can get some advice on how to get together my court bundle? Should i ask on the CAG website as i have just joined!

i may have done a silly thing then, because only the month and years was given on the charges table i guessed the date would either be on the 14th/15th of each month, thats the days my charges are usuaully taken.

I've done exactly the same thing Kev!
My approach will be to argue that as the information from Abbey was incomplete even though it was received late, as exemplified by the refund of the £10 data protection fee, I've adopted a reasonable approach based on other evidence received from them. In any event it makes no difference to the CAPITAL reclaimed only (possibly) the statutory interest which I wouldn't have been entitled to had they been reasonable and settled out of court!
I'm hoping that this example of an incomplete response and lack of full cooperation to a legitimate request will go in my favour if (when) we go to court.0 -
This may or may not be a useful tip.
The Customer Service (I use the word service loosely!) addresses appear to be PO Boxes which could potentially make it difficult to send items recorded delivery.
I've faxed letters to the fax number(s) shown on the letters. You then get a dated and timed slip from the fax machine confirming that you've sent the letter. You can keep that receipt as proof that they've received your letter if (when) they try to deny it.

I'm trying to look at it like having a bet on the gee gees. You pay your £80 (or whatever) as your stake and hopefully eventually get your winnings (what's owed) back plus your stake.
If you lose which you shouldn't on the balance of probability so far all you've lost is your stake as you didn't have the charges anyway!
Even if you do lose at least you can look at yourself in the mirror and know you did all you reasonably could not to let the !!!!!!!s grind you down!

Abbey's 40 days were up on 3rd May. Preparing to send complaint off to Information Commissioner. Got summary of 2004 charges at end of April with covering letter saying statements from 2001 to 2003 would follow shortly (yeah right - is that Abbey's "shortly" or real world "shortly"?) I've a feeling I know most of the customer complaints team now - I certainly know two of them have given me incorrect information regarding the SAR and the DPA!!!
Today the envelope dropped through the door - hurrah!!! :T Er no - some of them missing and some of them with ink splodges all over them!!! :wall: Rang the number on the covering letter - ended up in India (funny that - always wanted to go there....) - bounced back to the Bank Charges Team then bounced back to Customer Complaints who tried to bounce me back again to the Bank Charges Team - "Er I think not!" says I to the lovely young man who I fear is on the verge of a breakdown! Anyway - he sent - well he said he had anyway - an email to the bank charges team requesting them again - should be with me in 7-10 days. I'll reserve judgement on that one.....:rolleyes:
Also emailed Jackie Scott (Data Protection Compliance Team) who I have to say replied almost straight away! She's sent a copy of my email to Bradford so they can deal with it.
So glad Crapital One & the Woolwich weren't as shabby as the Abbey!!!0 -
Please help me with some advise.
My oh recently sent off a letter to the Abbey National to reclaim his bank charges,The account has been closed for approx 1.5 years.
I would say on average we had charges of at least 90 pounds a month while the account was open.
This morning we recieved a letter offering 120 pounds:eek: (a cheque to be issued in the next 10 days),with words to the effect of
"we are satisfied that the charges do not contravine the unfair terms in consumer contracts regulations 1999 that the office of fair trading announcement was in relation to credit card charges only not charges to other types of accounts,eg bank accounts,this means our tariff of charges continues to apply we provided you with these terms + regular updates when you opened the account"
"similary the info provided by uk banks to the House of Commons Treasury committee relate to credit card charges only,therefore the comments made do not relate to the issue of charges on bank accounts"
THEY SAY THEY WILL KEEP THE FILE OPEN FOR 8 WEEKS AND WILL ASSUME THE ISSUE IS RESOLVED IF THEY DON'T HEAR FROM US.
Please can anyone actually tell me where do we go from here,we think that we are intitled to at least 1000 pounds and the ammount offered is an insult.:mad:

Stick to the steps in Martin's article and just ignore their brush-offs. Send off another letter threatening court and then FILE A CLAIM.Reclaimed thanks to this site:

Yesterday i recieved a letter from Abbey which was the 18th May stateing
" I'm sorry you are unhappy with the charges and i understand you would like these refunded. Although the charges were correct, as a gesture of goodwill, i am happy to refund £645, this figure includes charges that have yet to be taken from your account. Your account will be undated within the next 10 working days."
The letter also said if i do not reply in the next 10 days they will settle for the £645. My problem with this the letter was dated the 9th May but i had recieved it yesterday on the 18th May. When i had checked my account money had been put in. My bank charges over the 6 years had accumalated to around £6000.
What do i do next0
