Just got my court date - right in the middle of my holidays. Before anyone mentions the allocation questionnaire bit - it's taken so long to get the court date that my holiday does now fall within the four months - it didn't when I filled it in. Can I ask for the date to be put back, or should I cancel the holiday and add the deposit to the claim?!I have plenty of willpower - it's won't power I need.

Im in the process of trying to claim back my charges from the worst banks abbey and natwest, i've followed all the letters and now have to go to court Ive not sent the court letter yet and was wondering if there was any cheaper way of doing it other than mcol as I cant afford the £100 ish to start the claim. Can it be done manually through the small claims would this work out any cheaper. anybody in the same boat as me? Ive no response im so fed up with it now its been going on since feb and march, funny there quick to take but not to give :mad: , nothing i do seems to work, letters, phone calls. even sent a email to abbey through their web site as a complaint, sent 100 emails kept pressing send, send etc, still get fobbed off why wont they listen!!! god I hate banks!!! please can somebody help? be good to hear anybody in the same boat as me

unfortunately i had a number that just doesnt work anymore ( like others have got) i think you have to wait till they send you the refusal to talk to them..but as every knows abbey are a bunch of idiots so just follow the steps on this site...Scrimping and saving!0 -
I posted letter 3 to Abbey and today I have received 2 letters back..... One saying they have employed someone to look into my complaint and will get back to me within 4 weeks - What I want to know is this a ploy to put me off and they won't be in touch again, so should I send the threaten to take legal action letter OR will they be in touch? I have been reading some of the success posts and wondered if anyone who has received their charges from abbey could give me some advice.
Letter 2 was saying they have turned my account over to the DMRS (Dept Management and Recovery Services) because my account is £134 overdrawn (this amount changes every letter they write me!) this is due to their own stupidity as they should have refunded me £140 and they haven't yet done so, I have included this in the reclaim charges! What will happen to this, is this just to frighten me?
Any advice would be greatfully received.

p.s Letter 1 they sent - I was also wondering as I was looking at the next steps, this letter comes under the ignored or refused so should I carry on and send the court letter (as I stated previously) because it also says DO NOT let the banks dictate time scales? I hope I have explained this properly?0 -
If you would like a copy of what i wrote to them just pm me!! I didnt get a response but a couple of days after emailing them about 4 times they turned up and my £10 was refunded!!!

Thanks for this Hugo - I was about to PM you for your info - arrived home from work today and a list of the charges has arrived from Abbey! So the minute I started emailing them they took action as it was over the 40 days so they had to. I guess they just hope people will go away and not have evidence of having requested the statements. Sending everything by recorded delivery in the first place, is well worth it.
So off to do my first letter to them...0 -

they dont need 4 weeks. be firm and stick to your timeline...14 days and then fire off the court warning.Scrimping and saving!0 -

Thats great news!!! well done!! I think they just hope people will go away to!!!
Get adding and get your letter sent out - Yeah sending recorded just gives you that evidence of delivery which i think banks use against you if you cant prove it!!
