if the last letter you sent abbey was the threatening them with court letter the next stage is to take them to court. i believe there is 2 ways to do this.
no1. N1 form which you can download and take to your nearest court and No. 2 is the mcol which is all done on line. what ever way you do it i wish you the best of luck.
I used the MCOL (Money Claim On Line) route which I found really simple and easy to use. I used the templates that you can find on CAG site. Don't feel intimidated by the Abbey - this is what they try to do to put you off claiming. Keep going, they will pay up!!

I assume you have written them two letters and the 14 days per each letter are over? File a court claim. No use waiting around for them.Reclaimed thanks to this site:

You could call the bank and ask what the time limit is on their "investigations."
It seems they keep using the 56 day excuse which is mentioned in various threads.
If they do you could right a letter stating you expect to recieve a satisfactory response within this time if your happy to wait for a figure.
Alternatively you could stick to your timetable and file a court claim, it depends how comfortable you are in going ahead with it.

I am in proccess of helping my daughter claim charges from Abbey, we have statement with the most recent (03 to date) with accompying letter saying been that if the account was opened before this date another statement will follow, this was over a week ago, the 40 days is up on the 14th June, is this common practise?
I'm just ahead of you in the process the promised further statements did arrive obviously backed up elsewhere0 -
The 56 days is not an excuse. The banks are allowed 8 weeks to respond to and deal with a customers complaint as per the guidelines laid down by the FSA. This is only relevant if you were to use the Financial Ombudsman as you would be required to exhaust the banks complaints procedure first.
As you are using the court route then there is no requirement to follow those timescales yourself. You need only show to the court that you have allowed ample time for them to respond to and deal with your claim. Providing you have sent the two letters and allowed the timescales laid out in the template letters in the main article (28 days total + any extra to allow for postal delay) then you are now entitled to file claim at court. I put a claim in for charges amounting to £560.00 plus interest with Abbey on 8 April 2007.
After a week I received the standard holding letter and than a week later I received a letter defending their right to charge and that as a good will gesture they would refund £50 quid.... how generous of them.
I then replied to them on 16 April with the second standard letter giving them 14 days to responded stating that I was not satisfied, however I have not received a response, the two week deadline I had set has long since passed and I then received a letter stating that a further £190.00 had been added in charges for a few direct debits that had not been cancelled so I decided to write a third time giving them the opportunity to respond within 7 days asking to claim back my £560.00 plus the addition £190.00 with interest. Well the 7 days ends today and I have not received so much as an acknowledgement letter.
I decided to ring them and see if they received my letters and to find out why they had not responded. I was told that they have an obligation to reply to my complaint within 8 weeks. Despite this I am sticking to my timetable and tomorrow I will be making a claim online to the courts to claim my money back.
Fingers crossed I get it back so I can close my account with Abbey who in my opinion are the worse bank for customer care and just general banking altogether.
I am sure that many of you are going through a similar process, my advice is to just stick with your timetable, as you have just read I have given the bank ample time to respond I’m sure if the shoe was on the other foot the bank wouldn’t be so patient. Any comments or extra advice is very much appreciated.0 -
