There's alot about having terms & conditions leaflet with your bundle claim if case goes before a judge. Where can I get a copy of the terms&"cons" for the bundle. Have they actually amended the current terms&cons to cover their backsides?0

Hello fellow claimants. I hope somebody can help me. I have just taken Abbey to court for £1, 031 inc £80.00 court costs. They have today acknowledged my claim. When I filled out the statement of truth on the MCOL website, I worked out the daily interest incorrectly. I spoke to the court today and they told me that it can be corrected at a later date if Abbey acknowledge or defend. I am freaking out right now. Has anyone else been in the same boat? Please could you advise me if possible. thank you x0

The court have already advised you on this, what exactly do you need to know that you dont already ?0 -

Hi all
Been trying to get charges back from Abbey since 1/2/07. After lots of letters with delaying tactics I eventually issued the summons. They had until tomorrow to decide how they would play it and I have received from the court a form to the effect that ABBEY will be defending and are asking for 28 days to get their case together.
What I will say is that I sent them a letter early April stating that I wish to reclaim 2 grand apporoximately but I would deduct £5 per transaction to acknowledge that there is a charge that I am accepting. In answer to this they wrote back stating they were going to pay me £50 as a goodwill gesture and they would put it into my bank in the next few days. As we were on holiday in France over Easter, I was not able to reply to this by declining their kind offer and found on return that indeed £20 and £30 had been put into the account. I wrote further explaining that I had not agreed to this 'goodwill gesture' and that I would also deduct £50 from the total that I am claiming through the courts.
Does anybody out there think I might be on better or worse ground as I have accepted £5 per transaction and so have basically said I appreciate they do have to charge. ?
The offer of £50 was in a letter that I would have thought would have been headed up with 'WITHOUT PREJUDICE' but it wasnt - could this have any bearing on the case at all ?
So, now I am waiting for a court date !!

i would say that £5 is a bit steep i deducted £2.50 which a judge in a court case agreed with so i went along with it in my claim..............since you've filed your claim already did you mention the £5 in you'r particulars of claims section?
if not and since your claim is for £2000 i wouldn't bother,when it comes to settle you can negotiate then.

Hi all
Finally got my statements - reclaiming charges on abbey credit card. I wrote to them on 18th May, asking for charges to be paid back (£400). They've sent me a patronising letter back dated 22 May "we want to complete a thorough investigation and sometimes this can take time". I've already waited nearly two months for the statments, which I only got by contacting ICO and by emailing them and chasing up. I'm thinking of just going straight to MCOL and this has sped things up with another bank! Any advice would be welcome; I could wait a couple of weeks, but I feel it might be a waste of time when they are just stalling.0 -

Hi Alice, I've just had the same stalling baloney "it may take time to investigate your claim blah blah blah" after letter number 2 claiming for my joint account, so I've sent my Letter Before Action (just following timescale guides on here). Judging by the successes with Abbey they do tend to take all claims to the wire and drag their feet. The decision whether to file now or not is up to you, why not send a Letter Before Action and see what that produces?:)
