I sent my second letter away on the 20th april and got a letter back very quickly saying that there looking in to my complaint but as the weeks went on I wrote a thread in this site and got a reply saying send them the third letter threating with court so I done that but I got a letter back today saying that my complaint will be another 4 weeks away before I will hear anything else what will I do now?
I am trying to claim back £3500 in scotland has anyone got any ideas how I go about claiming this back at court as the small claims court in scotland you can only claim £750 a time is there another way round this?

As an update, I just got hold of the court where my case is to be heard, they say I may not get a questionairre, the judges there are trying to hear these cases straight away, I may have a date in 2 weeks...flippin heck, can someone now advise on what I should be prepred to say! I have taken some notes from Cyberman ie..unlawfull to profit etc..what more should I have prepared? Anyone?0

Hello all,
I am wondering if anyone can help me, my bank have defended my claim and have now ask me for lots of information which i do not understand.
1) They have asked me for to give details of my bank account and of all the charges, which is easy enough.
2)They then go on and ask for me to clarify if it is the case of the claimant the same should not have been charged? (b) if yes please explain why the claimant contends that the same should not have been charged? (c) if no; is it the case of the claimant that the same should not have been charged in this amount? (d)if yes; please explain why the claimant contends that the same should not have been charged in this amount and identify the sum the claimant contends should have been charged.
It then goes on and says to specify the clause(s) pursant to which the charges were applied and if they were due to a breach of contract by the claimant and then to specify the breach if it was.
it finaly ask to specify the fact that it is an unfair term in consumer contracts regulations 1999.
on the money savers website he says that if the bank defend then there will be a small form to fill in but i have not recieved this but this great long letter asking for lots of information
Any help on this matter would be greatly welcomed.

Got a court date with Barclays and have submitted bundle as per Consumer Action Group. Thinking I need to do something else to emphasise the need for a full breakdown of all costs.
Can anyone comment on:

Copy to: Barclays leagal buff in London
Further to the Order made by District Judge D D Douce, dated 19th April 2007 in the Derby County Court, please find additional information below.
As I have received no correspondence from Barclays Bank since 23rd March 2007, which was an offer of settlement, I would like to request that Barclays Bank provide a full breakdown of their costs as detailed on the attached schedule both to myself and the court.
This request is made as I do not believe that a hearing can be conducted without a full breakdown of the costs incurred against each charge listed on the enclosed schedule which I am claiming to be unlawful. If this information is not provided I will request that the court obtain same during the hearing.

i hear that LLoyds tsb took someone to court and won!?!! thats scary! ive had a letter from Natwest saying they will pay back the full amount of the charges minus the interest so i have accepted this and am waiting for the money. Didnt want to take things further as im scared the tide is now turning!0

hi, how long has it taken to get your offer from natwest, did you send both letters (one threatening court action) any info would be great. thanks in advance0 -

Can anyone give me any advice?

MCOL states defence received effective 13/06/07 and I can go no further with my claim online. To date I have received nothing in writing from the court. Does anyone know how long this usually takes?
Also can anyone advise me as to what I should take along to the hearing once it is happening?
My bank is Abbey and the amount I am trying to reclaim is £2704. If anyone else is battling Abbey or sucessfully done so please get in touch so we can compare and maybe help each other along the way. It is quite un nerving to think that the average Joe Bloggs is taking a massive company to court!!!

Who has asked for this - the bank or the court? If it's the bank then it's not in their hands now. If it's the court go to the consumer action web site and there's info there on how to respond.0 -
Can anyone advise me, I sent my letter dated 7th May telling Alliance and Leicester that I was taking them to court if they do not reply within 14 days from date of letter, today I have received a reply dated 14 May saying they are looking into the issue and will reply within the next 28 days. Do I wait until the 28 days are up or do I start court proceedings on 21 May (14 days from date of my letter)? I have followed everything correctly from the beginning, my claim is for 163 pound.0
