I sent my letter 1 to the bank (Halifax plc) with a cheque on the 27th of March.

Still not heard anything nor has the cheque even been cashed.

Are they pretending to have not received it I wonder.

Should I resend - recorded delivery this time - with another cheque and asking them to cancel the last cheque or, take the next step?

I was really interested to read your post. I am on my third letter to First Direct, claiming about £4k plus interest. This is mainly made up of Excess O/D fees. They have sent me one letter saying that the don't agree the charges are unlawful, and refers me back to Part 2: Operating Your Account, Clause 6.9 blah, blah, blah.

I was wondering if this was your experience to, and how long the whole process took.

    Many thanks
if this question was for me, i sent the very first letter on 24/02/07. Fortunatly i have kept all my statements (something my mum taught me!!) for the Halifax so i didn't have to wait for those. However it looks like i haven't finished yet. my claim is still active and i'm going to phone MCO tomorrow for advise if halifax still haven't honoured the settlement then.

i'm now going to do my Lloyds TSB account and the late payment charges on my sister's Barclaycard for her.

i'm doing it one at a time as i'm generally quite disorganised and feel this is the best way for me.
    halifax: settled paid £2622.18:j
lloyds tsb: £1038.83 inc interest, but claim on hold.

Hi, yes it sounds like we are at similar stage - are you Barclays? In my court summons it says that I have 28 days from service of notice to provide xxxxxx - which is now approaching, so I have to send them what I have. Still don't think I have to provide the bank with it though - do I?

Good luck to you too - I'm currently in for £4,500, but they are piling them up even more since I went into the court process. I am going to try adding the extras to date in the court paperwork, and on the day of the appearance I am taking what I have between now and then. If it's not added by the court (assuming that I win!!) then I will ring Barclays and tell them that I will merely start the whole process again if they don't cough up. By that time I will be in funds and the charges will have stopped. :T

No Im with Nasty West and their even nastier solicitors Cobetts. My Notice of Allocation says "each party shall deliver to the other and to the court office copies of all documents on which they intend to rely at the hearing no later than 14 days before the hearing". I expect every court will be slightly different. The girl I spoke to this morning said they were inundated with these claims and couldnt keep up with them! SO KEEP IT GOING EVERYONE!! I was told by them once the hearing date is given you cant change your original claim but these extra charges can be brought to the attention of the judge on the hearing day and up to him to award them - assuming of course you win on the day!!!!!! Failing that, a fresh claim has to be started - BRING IT ON!!!

Im feeling so much better. Was so stressed last night and wondering if all worth the hassle but - as usual - when everyone started posting replies it keeps you going so thanks to everyone who replied to me last night and early this morning 7am!!!! My claim for 2400 but think there have been a further 200 further charges so far and court hearing not til 4 July so god knows what they will be by then!! Good luck and I will keep posted of developments JG
Nat West - MCOL March - FatWest defended - hearing date 4 July - 2300 claimed and still having charges put onto account!!

HSBC - sent 14 day - still waiting for reply. MCOL by end of week - claiming 795 - eventually paid out £560.

Halifax - sent for statements Feb - cheque cashed - nothing received - reported to FSA - paid up almost amount claimed before official complaint registered with FSA

I have a question I hope somebody can answer:

I had a bank account and a mortgage with the same company. The bank account went seriously overdrawn (with a lot of help from charges). The bank therefore said the only way to clear this was to add the bank account debt onto the mortgage. This has therfore increased the mortgage to the sum of around £10,000. If I claim charges back from the bank account, do the bank have to deduct this amount from the mortgage also, or do I have grounds to ask for this???????

Hi not sure it I am posting to correct thread here so please tell me if not.

OK Im overdrawn (potentially could clear this in a couple of months if that makes a difference) but also have a credit card with bank that I cannot afford to pay balance off could they ask for the overdraft and the credit card balance back ?

    Hi jayneg

So Cobetts act for Natwest. Interesting. Will Cobetts answer the question ... please give me a full breakdown of your £35 charge?
I doubt even Cobetts would dare to answer that !

Hi i was wondering if someone could help.

I posted a letter requesting a full refund together with a breakdown of my charges to my bank on 30/04/07, and had recieved a reply on the 2/05/07 (wow how quick was that!!) stateing they were looking into it and that i would have a further reply within four weeks.
However i am due to have a futher £90 bank charges go out of my account this week after finding out that the balance that shows on your online banking statement is not a true statement of your account ( why they bother putting a statement thats available online then i have no idea) Anyway, how should i go about claiming these charges back, can i claim them ontop of my already submitted claim or should i wait and ask for it later once the claim has been compleated.
I have to say so far Halifax have been nothing but accomidating after i requested my statements from my bank i recieved them within 7 days, i then had to request them again as i thought i had been with the bank longer than the amount of years of statements they had sent me, again they sent me my statements within 7 days and did not charge me.
Therefore i am allowing them the four weeks that they have requested to deal with my claim, however i am a little worried that i may be being too nice.
I am reclaiming £2332 for the last 2 1/2 years ( most of that occured during my college years).

    Any help would be appreciated

    Beth x x

I am yet to have a reply to this question can anyone help?

For those of you who did not see Watchdog tonight on BBC TV, they were bank bashing again. Well done Watchdog

    RESULTS:
    Lloyds TSB SETTLED IN FULL
    Halifax SETTLED IN FULL

ROYAL BANK OF SCOTLAND (They own Natwest)

OH DEAR, yet another breach by this bank.
Those shown on the programme who requested 6 years of bank charges discovered that the RBS had sent their personal information to strangers.
    INCREDIBLE BUT TRUE.

Imagine your private and personal information being sent to a complete stranger. Imagine that the stranger could clone you, use your information to steal your money, apply for loans and credit cards.
All the RBS could say was SORRY.
If you are still waiting for your statements from the RBS, it is possible that they have sent them to a stranger. You should contact the RBS immediately

I wonder if ... well maybe as the RBS own Natwest are they using Cobetts as their solicitors ???

And then the Commissioner who heads the Data Protection Service. All he could say was that he would investigate and issue a formal warning to the RBS. WARN THEM ! He should be applying severe penalty charges immediately. What is the point of a someone heading the Data Protection if he lets us down.

Then Watchdog exposed Halifax, they had rubbish bags full of personal information just left outside for the bin men. Watchdog found that in the bags were statements, bank account numbers and even a cheque waiting to be cleared.

All this information can be used against these banks .... USE IT WELL

    Hi there,

Hoping for some advice. Taking HSBC to court for £1200 and they defended last minute (surprise) and then I recieved a letter on the 13th April from the court stating that the claim was now transfering to my local court in Preston. But strangely its stated that "the filing of an allocation questionnaire be dispensed with in this case unless the District Judge at the court of transfer orders otherwise".

That was the last things I heard and that was over 3 weeks ago so I am taking it that I won't have to fill one out, but wondered if anyone was aware how much longer I should wait until I contact the court to see what is happening.

Also does anyone think that contacting the bank or solicitors (DG Solicitors) to see if they'll settle before court would be a good idea. They offered £850 ages ago but I am really gunning for the full £1200.

And whats this bundle that I have to put together? Will the lack of the allocation questionnaire mean I don't have to get the bundle to the court?

Any help as usual greatly appreciated.

    Thanks
