this morning got a "defence" letter from natwest aka cobbetts do not understand most of it,but paragraph 3.1 says
The particlars of claim set out no facts indicating what the claim is about, are incoherent and do not disclose any legally recognisable claim against the defendant...
paragraph 4 says
the defendant invites the claimant to remedy the above, in the event that the claimant fails to do so within 14 days of the service of the defendant then the defendant will apply to the court for an order striking out the particulars of claim..
Natwest did offer me a claim about a week ago but declined as it was not enough, question is do i need to send anything off or sit tight and wait for a court date to come through the post..
would appreciate some help bit confused and worried thanks x
Assuming you put down your particulars of claim precisely as is advised on this site (or another) then you dont have a problem. The solicitors job is to harrass you into feeling stupid and have you run round trying to put right something that you didnt get wrong in the first place.
Providing you are confident that the particulars of claim were done properly then sit tight and wait for your court date or more likely an offer of settlement before then. Good luck0 -
THANKS GUYS
appreciate your quick response xx0 -
I am re-posting this here as I am not sure how many people are looking at the Cahoot thread! We seem to be very select!! Any advice would be much appreciated! Thanks!

Is there anyone out there who has got this far with them and what was the result? They are awkward beyond belief!! Really need advice - what are they playing at??0 -

hi, i'm trying to claim back from Barclays but i am in a bit of a confused state this morning so any help please!! Case has been transferred to local court in Birmingham, i have had a 'General Form of Judgment Order' today stating that if by 4th June i have not served on the defendant further written particulars of the claim specifying the name, account number and sort code of the account referred to and a list of all the charges complained of showing date and amount of each charge and stated the reason for it the claim shall be struck out without further order. I assume i have to send copies of all correspondence, statments and my calculations taken from the calculater from this website but who do i send them to - there is the address of the court on the bottom of the letter so do i use that and send it all by registered post?? I'm begining to wish i had never started this process but i guess that is what the bank hope yu will think and just give up!!!0

This is the thing - I have no idea why. I assume this is a stalling tactic. The whole thing has been incredibly slow!! They sent me the defence ages ago. I just haven't heard of many Cahoot stories on this forum, apart from the fact that they are part of Abbey whom I know to be very tricky. Maybe this is to do with their foreign ownership!!! Advice most welcome. I guess I have months now to sit it out...0 -
Hi There
i got a reply from the second letter today from the clydesdale.
I find it hard to really understand what they are talking about in it,
It is short three paragrapher basically saying that they are reopening my complaint????
The first letter i recieved 14 days previously stated that if i didnt respond within eight weeks my complaint would be closed.
Do they even read the letters they get?
Any way they say that they will be looking into the complaint shortly and will respond.
Should i continue to contact the Ombudsman or wait to see what the come back with.(my fear or suspision is nothing)
Any sugestions
Cheers0 -
On April 2nd I sent off the download form to barclays requesting my statements. The cheque for £10 went through my account on the 9th April. To date I haven't received a reply although there are a couple of days left before the 40 days are up. This morning I telephoned Barclays to politiely chase it up, I was told that they couldn't tell me if it had or was being processed and that if I haven't received by Monday to ring them back and they'll look into why I haven't received. I stressed that I wasn't happy with the answer and pointed out that by law they were obliged to reply within the given time. Has anyone else experienced this and if so what move do I make if I don't receive and they tell me they're looking into it. Just had a thought - does it mean 40 working days?0

Firstly ask the court why this has been postponed, also ask Cahoot.
Yes they are owned by the Spanish group "Santander" who of late have spending a lot of money advertising themselves on TV.
If you cannot find out from the court or Cahoot then go straight to the top
and ask the question to Santander

They will not want bad publicity especially after spending so much money wooing UK customersThe Winner Takes it All0
