    send it to the bank's soliciter and the court with the case reference number on the paper work

    I paid for bailiffs. The warrant of execution was issued by the Court on the
    21st April. I have heard nothing. When I 'phoned the Court to ask if the Warrant had been executed by the Bailiffs, they appeared not to have
    the number of my claim. The Court said they had a backlog.I would appreciate advice from other people who have issued Warrants of Execution to be similry met with silence or success.

    I was really interested to read your post. I am on my third letter to First Direct, claiming about £4k plus interest. This is mainly made up of Excess O/D fees. They have sent me one letter saying that the don't agree the charges are unlawful, and refers me back to Part 2: Operating Your Account, Clause 6.9 blah, blah, blah.

    I was wondering if this was your experience to, and how long the whole process took.

    to court and being scared out of our wits by the charges getting higher and higher.

    Hi I sent a 'letter before action' (stating I would settle for a slightly lower amount) to LLoyds tsb, to their recovery centre, Andover. I haven't had a reply, now what? Do I go to MCOL? I can't really afford to do that until the end of the month. Does it matter if I leave if for a bit? Is there a time limit between actions?

    Oh also. If it does get to the MCOL stage. Can I recalculate the charges/interest, because the amount of interest (at 8%) will of changed from the date of my original letter to today (or to when I commence MCOL). Also they have charged me some more, so I will be adding them on.
  • Looks like I am going to court with HSBC. I started the whole process almost three months ago (28 Feb) and have had no communication from HSBC at all. I have called numerous times and pushed and finally received an acknowledgement letter, but I had already claimed using MCOL. Now they have defended the whole amount stating that the charges are fair and my account is goverened by personal banking conditions and the contractually agreed prices have been agreed by me on opening the account. Has anyone else had this happen? I have been looking on the site for a while and not many seem to result in court. Today, I have called HSBC and said the same to them, saying that it seems to have severley fallen the cracks on their side and was anyone intending to call to settle. The poor girl on the end of the phone really did all she could and apparently she is going to get a memo off the coorect department tonight to see what is happening as she thinks that someone should have been in touch by now. I am happy to go to court, but HELP!

    Yes they are owned by the Spanish group "Santander" who of late have spending a lot of money advertising themselves on TV.
    If you cannot find out from the court or Cahoot then go straight to the top
    and ask the question to Santander

    They will not want bad publicity especially after spending so much money wooing UK customers
    Thanks Cyberman - I'll give the court a ring tomorrow and see if they know what is going on. Failing that I'll ring Abbey.

    Having that's it's illegal for banks to close accounts, do they get nasty with customers? Has anyone had any experience with RBS?

    Not only is my personal account with them (I calculate that I've had around £1800 of charges over last six years) but I also have a loan, a mortgage and my business accounts with them. RBS supply me with a relationship manager that manages both my personal and business accounts. Are they given instructions on how to deal with these claims? Should I move my business accounts before I claim? Am I right to worry?
