when claiming your bank charges back is easy or quit had to do, is there more to it than sending letters?0

On April 2nd I sent off the download form to barclays requesting my statements. The cheque for £10 went through my account on the 9th April. To date I haven't received a reply although there are a couple of days left before the 40 days are up. This morning I telephoned Barclays to politiely chase it up, I was told that they couldn't tell me if it had or was being processed and that if I haven't received by Monday to ring them back and they'll look into why I haven't received. I stressed that I wasn't happy with the answer and pointed out that by law they were obliged to reply within the given time. Has anyone else experienced this and if so what move do I make if I don't receive and they tell me they're looking into it. Just had a thought - does it mean 40 working days?
My husband got his in the post on day 40 (not working days either). Cutting it fine. They also refunded his £10 into his account.0 -

Sure the banks class this as revenue even though the figure is monopoly money. But, it's false revenue they reclaim. They could make up any old figure, charge the customer and then say it was a bad debt. This means that any business with a bad debt can add charges ad lib and claim the total back thereby reducing their own corporation tax liability. If the Inland Revenue caught a company doing this, all hell would be let loose.
Why do they allow banks to do it.
Not true, if the banks did this, they would not pass audits! As most banks are plcs, they are required by law to be audited independently. They have additional requirements under the banking code as well, so they couldn't "make up any old figure". Furthermore, a charge would be classed as revenue, and subject to corporation tax. They wouldn't reduce their liability to the revenue, they would increase it.0 -

looking for a bit of advice, I have sent the first of Martin's letters off to Smile bank, requesting that they reduce, rather than refund my overdraft charges. I went £1 overdrawn and have accrued £751 worth of charges.
They have replied with a rather Blah response, that i should look at the Bank's complaints procedure and that they will be touch. They haven't yet; the letter they sent arrived on the 3rd should i wait a little longer? or Send the second letter now ?0 -

By my reckoning, if you closed your account in 2000 as stated then you are outside the six years anyway, you can only go back to april/may 2001, although you can claim back further then six years you need to know your way around the statute of limitations...
Surely though, the claim should date from when I first sent them the letter (13th December 2006), meaning I should be able to go back to December 2000?
I may have to hunt around for the older statements, but I might well still have them. Could you let me know where I can find more information on the statute of limitations please?0 -
hi guys, this is my first post.
just thought i would post on here so i can rely on your help and support through reclaiming my money (hopefully!)
basically i sent a letter to my local barclays bank 34 days ago and not heard anything as of yet. have i made a mistake and should have sent it to the account holding branch or will it get sorted either way? the £10 charge has not gone out of my account yet.
if anyone can help it would be much appreciated

I sent of my letter to HSBC 41 days ago and have not heard back. :mad: I'm sending another letter today recorded delivery to make sure they get it.
The only thing is the account that I'm trying to get info from is now closed and has been for a while so I don't have the account number anymore, I've given them my name, old address that they would have had and sort code to narrow it down.
Does anyone know how good or bad HSBC are at responding to the initial request for charge information.
And I went onto the Data Comissioner website and that says you should allow 20 working days and not complain to them untill you've complained to the company you are trying to get information from.0 -
I started court action by using the on-line site and Lloyds have responded by saying that they wish to defend ( as advertised on your web site). However, when I instigated court action I did it in only the most general terms. The court officials have informed me of lloyds decision but do NOT require completion of a Court Allocation Questionnaire. Does anyone have any experience of this and if so have I jeopardised my action by not filling in the original form more fully?

I am about to embark on claiming a small charge of £76 from Natwest. I have been with them for just over a year and have been charged three times now. The first time they didn't allow a minimim creditcard payment of £7 to go from my account, and instead charged me £38. This is turn meant that my DD to my barclaycard was halted (and then they charged my for not paying which took me over my credit limit - and they charged me again!!!)
So basically, because Natwest didn't allow this payment to go I was now being charged from all sides. And unfortunately, didn't realise my DD had stopped for my Barclaycard so missed the next payment!! (and - as you may have guessed, was charged again!)
Anyway, this bank holiday weekend meant that my phonebill left my account early (before I was paid this week) and on the same day Barclaycard took their "minimum payment" of £67!!!!! (I was under the impression it ws more like £7.........but they added the charges to this)
I now have a charge from Natwest of £76 because they had to recall the money for the phonebill and the credit card payment.
Does this all sound like I'm entitled to claim??

Alice, you are one of countless thousands this is happening to. YES if Natwest have applied the £35 charges then go and get it back. Suggest you write to them first though, the amount is small so they may just pay you back straight away. Otherwise, its a case of court. I wonder how many summons Natwest have received so far, it must be an awesome amount.
As Natwest say ... "There is another way" DEAD RIGHT >>> SUE THEM
We are really beginning to wonder if these banks actually employ real human beings or are they using droids nowadays
