Lloyds TSB - Claiming £868 including court cost

Gone through the motions of the 2 initial letters and started court proceeding and was issued at the start of last week with a court date of the 13th July.

It state that the courts will need any supporting documentation from myself and Lloyds to be received by the court no later than the 18th May.

Can anyone tell me if Lloyds will pay up before the 18th May or will they submit there evidence. Also if should i still carry on and supply all me relevant documents regardless.

Finally i received a reply on saturday to my second letter of the 27th February basically saying we still stand by our dicission and we notice you have issued court porceeding.

    Comments would be appreciated.

I would say that one at a time is your best bet.
Probably save on confusion and time.

    leeburty,
This is just another method trying to put you off.
1: Assuming you are claiming the penalty charges
2: Assuming you have provided the Court with full information
IE: Copies of these penalty charges
3: If the above is in order, what defence do Lloyds have ?????

Are they going to explain to the court how they arrive at their penalty charges ?? NO ..... See why by reading previous posts on this forum

We seem to be at similar stage - my date is 4 July. I replied above that there isnt a further fee for me when AQ dispensed with BUT it is up the individual court so people MUST check this as they only have 14 days to pay up. I was told not to copy all the documenation until last minute - you have until 14 working days before the hearing date to get the documentation to the bank/solicitors and court. I was told as it is likely the banks will make offer before hearing date - its a lot of copying to do for nothing!! Iv made a calander note when I have to get the docs in by. Good luck in your claim JG

Hi, yes it sounds like we are at similar stage - are you Barclays? In my court summons it says that I have 28 days from service of notice to provide xxxxxx - which is now approaching, so I have to send them what I have. Still don't think I have to provide the bank with it though - do I?

Good luck to you too - I'm currently in for £4,500, but they are piling them up even more since I went into the court process. I am going to try adding the extras to date in the court paperwork, and on the day of the appearance I am taking what I have between now and then. If it's not added by the court (assuming that I win!!) then I will ring Barclays and tell them that I will merely start the whole process again if they don't cough up. By that time I will be in funds and the charges will have stopped. :T

I am nearly finished with my online Money Claim application but am a bit puzzled. I am claiming interest so do I put down the total amount claimed at £965 (total charges) or £1162.67 (plus interest)? There's a bit of difference in the court fee!

I was with HSBC and that's who I am claiming the money from. I've sent two letters and have only had an acknowledgement to the first one. It's well over a month since the first letter but I read somewhere it can take them eight weeks to make an offer. Is is worth going ahead with the claim now or holding back a couple more weeks?

    Sorry for silly questions!
Got £820 back from HSBC! Now entering comps like mad with the hope of winning a nice long holiday....

this isn't quite a success story yet!!

i have gone all the way to the 28 defence stage with moneyclaim online against the Halifax who stated they intented to defend against my claim....

however, (halfway through the 28 day defense period) i recieved a letter on 2nd of this month. it states that the halifax have decided it's not in their interest to continue to defend against my claim and will settle by paying me the full amount+interest+bank charges within the next 5 working days. this runs out tommorrow and i haven't recieved the money yet.

i have just phoned their customer relations manager to inform him i accept their settlement and will stop the claim as soon as i have access to the money. he promptly told me that the cashiers have "overlooked" my payment and he would email them immediately and tell them to pay me by close of business today.

so, fingers crossed i get my money today............
    halifax: settled paid £2622.18:j
lloyds tsb: £1038.83 inc interest, but claim on hold.

I sent a letter requesting charges from Natwest on the 7th April. I then sent another on the 18thApril with the payment of £5.00. I then emailed customer services on the 5th May, asking for a follow up. They replied saying they had no knowledge of my application. I then sent a reply giving them the information was signed for by their offices on the 12th April and to follow it up. Is this a typical stalling technique????

i put the amount including interest and claim the court fee back too.

i would also press on with your timescale as the bank will just delay and delay for as long as they can!!
