First of all they won't pay any interest as this only comes in to play if the case goes to court.

If you don't want to accept the offer you need to write back and say that you refuse the offer and will be proceeding with court action in 14 days for the full amount, basically the second letter but include your refusal of their offer in the letter.

    Thread about Monument is here...

Thanks Edinburghlass and Dwarfer for advice, think i'll send second letter and see what happens. thanks again

Hi All, I hope someone can shed some light!

I am taking my bank to court over 2 accounts i have with them. The one claim is ok because its well under the £5K limit for small claims.

However my other account has £5038 of charges, with interest this makes £5808 (using the wonderful calculator!). Now Martin says that its worthwhile rounding this down to the £5K limit to reduce costs and reduce the risk of it not being handled as a small claim. He also states that this is for the claim amount BEFORE you add statutory interest. Therefore I should claim the £5K plus interest. But the help window on MCOL says that the claim amount should include interest, so when you calculate the cost, it bumps it up from a £120 fee to a £250 fee. The extra cost isn't a problem as this will be added to the judgment, but will it still be looked at as a small claim?

Also, and this is probably a daft question, but I presume for each claim I make, I have to put the details of the account number? and do I put that somewhere in the particulars of claim?

    Hope someone can help!

    Cheers
Have now filed my MCOL for the one account, can anyone with the above query? cheers

    2 QUESTIONS:
I am claiming against HSBC and have just received the letter from the court saying that they are defending and therefore have 28 days etc. Since writing my 1st letter (must reply in 14 days etc) to HSBC I have been charged £50 in Notified fee charges which led me to become overdrawn, yesterday I was charged another £50 can I claim this £100 back?
My problem is I am self employed and therefore have not got a regular weekly/monthly income so they think my account is badly managed.....how am I suppose to manage my account when they keep taking £50 every month without notifying me? The first I hear of it is when they take the money out.

Having followed the steps I filed my claim via MCOL on 07/04/07. On 9/04/07 I received a letter from HSBC dated 26/03/07 requesting that I send a list of the dates of the charges and the description, should I be replying to this letter? they have all my statements surely this is just a delay tactic?

if you're talking about the small claims court then this is just a little note to say dont panic! lots of claims enter this stage, its the banks tactic to try to scare you and trying to get you to back down

again, if its the small claims you only have to fill in a form, you don't go anywhere or you dont need a solicitor :)

remember, this is just a nice notice reminding you not to back down, wait for another response

    hope this helps

If you change your claim now it will cost you £35, please read the MCOL site regarding this.

Please read this thread but basically if they are asking for another list of your charges just send them the list.

Is it possible to claim compensation on an unfair bank claim? Ive been fighting my bank for over a year. And have spent a lot of money going back and forth to my bank trying to get them to resolve the issue.

    Has anyone else got compensation?

Sent 1st letter to them, received reply saying not going to pay any default charges, is this a standard letter and should i proceed to next step, i.e 2nd letter ?
