  • Does anyone know how to work out the interest that the banks charge.
    I am going to have a go at claiming the interest that was added on to the charges as I would not of paid that portion of interest if they hadn't of put those charges on. Also I wouldn't have gone over my arranged borrowing if they hadn't added charges on then interest at 29.5%.

    I need to work out 14.9% pa and 29.5% pa.
    after all if the charges are unlawful then the interest on the charges must also be unlawful.
    My Mission today is to have an opinion on everything.
    If you don't like it well you will just have to lump it!

    can anyone give me advice .i have accepted a settlement on wensday from halifax but the 14 days are up can i still claim the full amount.or do i have to cancel the court claim .if so can i do this on line . what a muppet i am the offer was to tempting but after thinking about it .its my MONEY

    If you have accepted the offer in writing you can't now carry on. Don't cancel the claim until the money is in your account, once it is then phone or email MCOL to say you have accepted an offer and the case is closed.

    Looks tricky but I'd personally reject their offer and take this section of their letter and run with it:

    "whilst the bank do not doubt that the additions feature may have been missold to you ..."

    and run straight to the Financial Ombudsman. Regardless of anything else in the letter they have admitted the product may have been missold. I would let the FO decide whether they should refund in full and the complaint to them is free. Good luck :)

    No, don't sit tight! They've obviously just forgotton to enclose the form. On the covering letter it will have a cut off date for the Allocation Questionnaire, so call them to get a form and make sure you get it in before the due date.

    You could also go to go to the HM Courts Website and complete the form online and print it. Here's the link:

    Hi everyone, I'm new on here. I claimed £3455 (which is including interest) from HSBC. They ignored my first and second letters so I filled out the court claim and paid £120. Had a letter from the court saying they were going to defend the claim, then yesterday had a letter from HSBC offering £2375. They say they don't agree with paying the interest. I am tempted to take this, what do you think?

    You are entitled to the interest. If you hold out you will get it. It is only a matter of time. It is extremely unlikely it will get to hearing stage. It depends how desperate you are for the money

    The claim is at court stage and you are entitled to interest now on judgement in your favour. Some stats from the first 98 pages of the success thread for your consideration:

    HSBC - 115 cases of which:

    72 cases settled for less than the amount claimed but for not much less than claimed, presumably without interest
    32 cases were settled in full without the need for court and some after the first letter only
    7 were settled for more than the claimed amount, no mention of court in these cases and I assume interest was given before court

    Of 4 court cases noted:

    2 were settled in full by, the bank did not defend and default judgement was awarded after 14 days
    1 settled in full after court claim filed
    1 settled for less after court claim filed and it was accepted by the claimant
