    I started proceedings against HSBC via MCOL on 4/4/07 claiming £689 for unfair bank charges. This includes court fees. This was deemed to be served on 9th april 2007. And they had until monday 23rd april 2007 to reply.

    I recived a letter from MCOL saying the claim had been acknowleged by HSBC on 11/04/07 and they intend to defend the claim. What does this mean???? what should be my next step????? what do i do???? pls help me?????

    Don`t panic!!!!! This happens to lots of people. Read back through the threads and you will find out what the next step is. From what i understand (and i am no expert) if they defend, you will be sent a short questionnaire by the court, and somewhere on here there is help to fill it out. I`m sorry i can`t be of more help but i`m a step behind you on my claim, but i`ve read lots and i know its common now for them to enter a defence.
  • Twinkly, thank you for the advice re the overdraft/asking for bank charges situation. I intended to have everything in place before proceeding anyway. The offset thing is fine - they can take it to repay the overdraft if they like. As long as the money is used for my benefit. I don't know why I stayed with First Direct for so long - their penalties for going over small amounts was so huge and so frequent that one year I worked out it had cost me £100 a month to keep my account. In nine years I was never offered a single refund of charges, even though in the final months with them I had called to explain that I was really struggling with 2 mortgages (buyer pulled out of house sale). In fact, during my final conversation with them when I was pleading with them to freeze my penalties and the direct debit for my credit card that month in order that I could afford food (it was that bad), the employee noticed that I no longer had an income from the rental of the property and, as my monthly earnings did not reach the required £1000 per month to keep my cheque account open, they withdrew services there and then and began arrangements for me to pay everything off. There's compassion for you.

    I guess they have their newer target customers in their sights now and it is very clear that they no longer want anyone who is struggling. But they have been brutal in their quest for more upmarket clientele. They bent over backwards for me during the years when the big wages were coming in, but they penalised me severely and relentlessly when I was at my most vulnerable and lowest point. It was a move that demeaned me tremendously. That's business.

    That's fair enough it was just my opinion and what I based it on was the fact that 7wks after I sent my 1st letter to Natwest asking for my money back I got an offer of all my charges back minus the interest, but because I'd already started court proceedings I couldn't take their offer without losing £80. Of course I did leave 3wks between sending them my 2nd letter and starting court proceedings

    That's exactly what's happened to me. I got the letter today saying they intend to defend the claim and reading the posts it seems to be happening to a lot of people and for some they 're paying before the deadline is up, but if they do enter a defense then there seems to be help here with filling out the form they send. I'm just trying not to worry too much about it at the moment as there's nothing I can do until either they enter a defense or the 16th May when I can apply for judgement. Good luck and I hope both of us have good news soon

    this is a negotiation ploy, martin (moneyexpert) said in his video that its upto you to accept, or carry on. but the lightlyhood is that you will win if you push, but at least, BARGAIN with your bank, ask for a bit more than what they are offering

  • I have claimed repayment of my bank charges, issued a summons (which was acknowledged at the last second) and am waiting for the further 14 days to be up. I have, however, received an interesting mailing from my bank amending their terms and conditions. From now onwards, when I go overdrawn in excess of my facility, this will be treated in the same way as an application for an extension of my overdraft. Each time I will be charged for them to "consider" my new overdraft application. Crafty Barclays! Normally when I receive the bumpf I skim through it and bin it. As I am taking them to court, I thought I had better read it and there it was tucked away on page 3 of 4!

    First of all they won't pay any interest as this only comes in to play if the case goes to court.

    If you don't want to accept the offer you need to write back and say that you refuse the offer and will be proceeding with court action in 14 days for the full amount, basically the second letter but include your refusal of their offer in the letter.
