I am very new to all of this but have been incredibly encouraged in doing what I am doing by the amazing support yourself and others provide here. Thank you.
I am in the process of claiming almost £4,000 in unlawful bank charges from Abbey - who I gather are notoriously difficult. Having written several unsuccessful letters to Abbey using Martin's templates, but getting nowhere...I eventually lodged my claim with moneyclaim online. Abbey decided to defend, which didn't surprise me really. I had a copy of their defence a few days ago, which their lawyer sent me...pretty much predictable in terms of what others have said...including that I was claiming interest and charges over the six years allowed.
Today I received papers from the court...Notice of Transfer of Proceedings and also a second page that says, "Without hearing it is ordered that...1. The filing of an allocation questionnaire be dispensed with in this case unless the District Judge at the court of transfer orders otherwise." It also says that any party can apply to have it set aside, varied or stayed but must apply within 14 days and that an allocation fee may be payable.
Can I please ask what all of this means and if I continue from here or give up now?

I received my list of charges this morning and I got them for free!! First letter is on it's way asking for £540, I even said please:p I wonder if they will be as difficult as Nationwide are being:mad:0

Hi ya, I was just wondering, I sent my letter off to the Ulster Bank on the 16 April. I havent even recieved an acknowledgement letter to say that they have recieved it, should I ring to check as I am afraid they will say that they never recieved my letter which will postpone me for another 14 days. Hi guys
I received my allocation questionnaire this morning, thought I would! Was all fired up ti complete it and take it to my court on Monday (work next door, handy!) when I looked at it and got all confused!Parts 1,2 and 3 have been completed by LLOYDS. But part 4 - IF YO UWISH TO MAKE A CLAIM AGAINST THE CLAIMANT (is this now LLOYDS as it is their defence?) do I just put in the amount of money, including court costs, the extra £100 and the 8% interest? and then put th enature of the claim and then sign it?
SOrry to take up space, couldn't find this question asked before. I'm wondering if I should just give up now as it sounds like LLOYDS might win. Please help me!

Ive recently made a claim against Alliance and Leicester in my local county court after sending 2 letters, both of which were rejected. Id like to ask if anyone knows how long they take to settle, I know each bank seems to follow a pattern and I know A&L pay out after stating they will defend. My paperwork states that they have til 8th May to reply to my claim, does it go beyond that date if they defend it? Or do they write stating a defence then pay out anyway?0

Trying to claim from GE money, mortgage charges. Got letter this morning saying that they will not be refunding any charges. This mortgage account now closed. Has anyone been successful in claiming against these, don't know what to do next, just send the second letter threatening court action. Any advice very grateful.0

Phoned the bank and spoke to a call handler who said they can't offer anymore so I've sent a letter to Natwest using the pre-paid letter they sent me for accepting their offer saying I would accept an offer of £698 which is their offer of £618 plus £80 court costs that it cost me to start the claim but minus the £90 interest.
Today a letter arrived from the court saying that Natwest had awknowledged my claim and were preparing a defense and have 28 days to do this.0 -
