Hi Guys I Know I Have Asked A Couple Of Questions Before But Dont Seem To Have Got Very Far... Feeling A Bit Nervous About Things At The Moment As I Have Just Reached The On Line Claim Stage And The Bank Has Till The 6th Of May To Put In A Defence I Have A Couple Of Queries If Anyone Can Help Me .. Firstly When I Completed The Online Claim There Was Only Was Space For A Name And The Account I Am Claiming On Is In Joint Names Should I Contact The Courts About This, When I First Completed The Claim I Did Ring The Courts And They Said That Any Additional Information Could Be Sent To The Courts For Free And Any Ammendments Would Be A One Off Charge Of £35 So Where The Joint Names Are Concerned Should I Just Leave It As My Husband Is More Than Happy To Let Me Do It All!! Also When I Completed The Section Of Paticulars Of Claim I Only Put A Breif Outline Of The Claim But Inserted The Phrase It Told Me To Reagerding The Interest But I Have Read Since Then A More In Depth Version Of This Should I Type This Out And Send To The Courts ?? Or Just Leave It And See.... Also Another Worry Is When Filling In The Address Of The Bank I Couldnt Find Any Addresses At The Time So I Put The Address Of Where I Have Recieved The Letteres From When I Firstly Asked For My Money Back Which Is Neither The Local Branch Or The Head Office....lastly I Have Since Read That I Will Need A Spread Sheet Of The Charges Can Anyone Give Me Advice On This And How To Do It Any Help And Comments From Anyone Would Be Great As Not Sleeping Due To The Worry Many Thanks0

The story on this was in 2001 i was not well and they kicked me while i was down. so out of all the bank's/CC companys this was the one i WAS going all the way with. but it didnt get that far. they have offered and paid in full. they sent it to the address i lived at 6 years ago though. good job my mate still lives there. and some of the charges were 7 years old. im seroiusly thinking about trying my luck with hsbc for the last 12 years. anyone know if i can do this?
oh and the letter was lauhable i ll post it when my scanner is working.. i laughed at the wording...If i upset you don't stress, never forget that god aint finished with me yet.0 -

Please can you advise if i can be exempt from paying mcol charges if i get working or child tax credit.
i have not got to this stage with my claims yet, but does the online mcol system allow for this?

I am very new to all of this but have been incredibly encouraged in doing what I am doing by the amazing support yourself and others provide here. Thank you.
I am in the process of claiming almost £4,000 in unlawful bank charges from Abbey - who I gather are notoriously difficult. Having written several unsuccessful letters to Abbey using Martin's templates, but getting nowhere...I eventually lodged my claim with moneyclaim online. Abbey decided to defend, which didn't surprise me really. I had a copy of their defence a few days ago, which their lawyer sent me...pretty much predictable in terms of what others have said...including that I was claiming interest and charges over the six years allowed.
Today I received papers from the court...Notice of Transfer of Proceedings and also a second page that says, "Without hearing it is ordered that...1. The filing of an allocation questionnaire be dispensed with in this case unless the District Judge at the court of transfer orders otherwise." It also says that any party can apply to have it set aside, varied or stayed but must apply within 14 days and that an allocation fee may be payable.
Can I please ask what all of this means and if I continue from here or give up now?

What if I cannot afford the fee?
The fee you will have to pay to the court will depend on the amount you are claiming, including interest. You will have to pay a court fee unless:
• you or your partner receive Income Support;
• you or your partner receive Pension Credit guarantee credit;
• you receive Income-based Job Seeker’s Allowance;
• you receive Working Tax Credit* with a ‘disability element’ or ‘severe disability element’;
• you and your partner receive Working Tax Credit* and Child Tax Credit between you;
(* Please ask the court staff for the current gross annual income cut-off which will determine whether you are eligible.)
If you show that the payment of a court fee would involve undue hardship to you, the Court Manager may reduce the fee or “remit” (say you do not have to pay) the fee.
For further information, or to apply for fee exemption or remission, ask the court staff for a copy of the combined booklet and form EX160A - Court Fees - do I have to pay them? This is also available from any county court office, or from our website

Morning everyone. Very disappointed and a bit worried. I have received my order this morning from my local court (me v. Barclays). The hearing is not set until 25th July!! Two major problems - I am on holiday - booked in January. What do I do? Second, they are asking me to send certain documents to both Court and Defendant. I have a real problem here. I was sent reams of copy statements, which I trawled and produced an Exel schedule of dates, charges and reasons. I have this, along with the interest calculater used and sent to them. I can see why the court need me to send these, but Barclays have them, and they sent me the statements in the first place! Unfortunately, when I had finished my work, the statements were in a carrier bag, and I can only think the cleaner at work collected them and binned them. As I say, I have a schedule listing all the information, but not the copies. I could pay my £10 and ask for them again, but I only have 28 days. Can I send the schedule and copy interest calculator and follow up with the statements, or will they strike my claim for failure to comply? I really need this money, and could have done with a lot sooner than the end of July. I am seriously concerned.0

Having reclaimed £1572 from my bank, I have been encouraging everyone I know to claim.
My colleague requested her charges under the data protection act, enclosing her cheque for £10
At the end of the forty day period she received All her statements for six years. If this is what she had asked for, she would have been charged £5 per sheet. I haven't counted the sheets but there must be at least 100 of them!
They have moved the goalposts to suit the situation. At the moment the statements are just sitting there as she hasn't got around to doing anything with them yet. I have offered to help her, as I have more of an idea what can be claimed. This is another tactic. They expect that it will confuse people, delay claims and hopefully deter some completely.
I am wondering whether the template could be slightly modified, stating that only a summary of the relevant charges will be accepted, or whether the banks will have been deemed to have performed their statutory duty, by providing the information requested, albeit in a less than helpful form“The primary cause of unhappiness is never the situation but your thoughts about it.” Eckhart Tolle0
