 I am helping my sister to reclaim charges from Abbey (back to 2002). I applied using the template letter but what I got back was useless. Lists and lists of spends but no info on the charges incurred, or the balances. I don't want to let that deter me... Is this their usual ploy?

We have already opened a new account, so that one is dormant for now:cool:

Clearly I need to write back and reiterate that it is the charges info I want, unless you can suggest anything else:confused:

abby ARE difficult to get money back, ive heard nothing but bad stories with abby claiming fees back, more than likely the whole staff have been told NOT to be lenient. someones getting greedy up there in abby!

In fact many people have to go back to the bank and actually ask for the copy statements as sometimes the listings of charges can't be read by the layman and don't have the information against them that are needed to extract the correct charges that can be reclaimed. (edited to add, as the above post that is quoted)

I don't see it as a delaying tactic by the banks to send out copy statements more they are anticipating that, that is the way people want the information required.

iglimpse, they are obliged to give you the information but the onus is on you to list out the charges etc I'm afraid.

 How / where would I ever begin to work out what they have charged her since 2002. It does not give balances either. At this rate, it looks like I would have to pay an accountant to do this!!

I requested information which they have not given me. My sister has a learning disability, her perception of all this is that somebody was stealing money from her account :o the voice of innocence!

However, I do know that this all stems from one occasion when she went overdrawn, everything just snowballed from there - charges on charges:eek : for 4 years.

In the end, as soon as her benefits went in, she drew it all out again "before anyone else could take it" As you can imagine she was then overdrawn for most of the month

I have her statements for the last 6 months which give details of charges. Shall I just take a figure from that and multiply it by 7, call it an approximate figure / educated guess.

No, dont estimate. You ask them to send you a list of fees in the past 6 years, since your sister has been in bother with them for 4 years she was only in debt because the banks kept taking her money. REQUEST FEES SINCE 2001 WITH INTEREST,.,.. YOU'RE A WINNER! I cannot see how a court will justify this. oh and I will leave your bank!

My claim has gone all the way to the Abbey National filing a defence. I'm claiming almost 1000 pounds and am now waiting to hear from the court when the case will be heard. I'm a bit (very!) worried....not sure I want to go and stand in court. Can anybody else give me advice or has anyone got this far with a claim from the Abbey?

DO NOT WORRY! Abby are difficult swines their staff have been told NOT to be lenient so they try to scare you and thats the whole idea so you'll back down. ABBY ARE GREEDY!

they have NOT got a prayre if they do goto court it will be their disadvantage

STICK TO YOUR GUNS AT ALL TIMES! THEY WILL TRY ANYTHING TO STOP YOU TAKING THE FEES BACK, AND ALMOST DEFINATELY THEY WILL NEVER GO TO COURT, THEY CANNOT AFFORD TOO BECAUSE IF THEY LOSE THEY WILL LOSE BILLIONS IN RECLAIMING EVERYBODY'S FEES BACK SINCE IT WILL NO LONGER BE LEGAL.

good luck, but you dont need it :D

I haven't counted the sheets but there must be at least 100 of them!

They have moved the goalposts to suit the situation. At the moment the statements are just sitting there as she hasn't got around to doing anything with them yet. I have offered to help her, as I have more of an idea what can be claimed. This is another tactic. They expect that it will confuse people, delay claims and hopefully deter some completely.

If you have an online banking system it may have a search facility within it. I found all my 5yrs fees within 5 minutes, it does it for you! Just search for the relivent keywords, such like "fee" and "unpaid". :D really easy! again, it searches your statements and fishes them out for you.

As advised by Twinkly wrote to Barclays to ask for refunds of all the charges taken from my bank account for an Addittions account that they bestowed upon me not even informing me of charges. After a few phone calls firstly offering me nothing, then offering me 6 months refund which i flatly refused {as they owe me money since 2003} i received a letter from Barclays today saying as follows .........unfortunately the bank cannot justify why you would be eligible for a full refund of fees (i didnt sign anything ask for anything they just give it to me without informing me of any fees!!!!)whilst the bank do not doubt that the additions feature may have been missold to you the fact remains that you have been in regular receipt of quarterly statements that has clearly stated that your account was additions as well as show each monthly fee for this account. You have had ample opportuninty to raise this with the bank to do so (still signed nothing, agreed nothing, only brought to my attention after watching whistleblower ) By your own admission you have failed to check your account statments however it would be unrealistic that such an error would go unnoticed for 3 years (so because i didnt know what that this fee was it was still ok for them to keep my money!!)As well as this our decision is supported by the fact that you have consistently used your overdraft limit the first £250 has been interest free (had an overdraft since i have had a bank account)as this constitutes the use of a primary feature of the additions account the bank remain assured that the offer of a years charges is completly fair and reasonable compromise to bring this matter to a mutually satisfactory conclusion. .............should i still continue to go for my full refund of my charges ? any suggestions (twinkly)?
