    Hi, I too am "taking on" HSBC, I filed and paid the court fee of 120 on the 11th April. I have received today acknowledgement of service from the court and a response from HSBC's sols stating that they are intending to defend the claim. They now have 28days to fiel a defence. So now i just sit and wait.
    The bank has approv 14days to reply (ack of service) if this is not done you can ask the court to enter a judgement on your behalf.
    Have ou received a Notice of Issue letter from the court yet?

    I have read on these forums that you can claim charges back that are older than the last 6 years. Is this true and if so how would I go about it?

    Do I go through the same process or do I need to alter the method slightly?

    How long do the bank keep my statements on record?
    Natwest - LBA sent 26/04/07, FO. Sent email to Michael Duncan on 11/05/07. SUCCESS - Offer letter received 19/05/07 for full amount.
    Natwest Credit Card - 1st letter sent 27/4/2007 (£294) SUCCESS - Full amount repaid
    Capital One - 1st Letter 03/2007, FO in Sep 07. SUCCESS full amount repaid Jan 08

    I sent away for my statements from the Halifax and they sent them out within two week, I went through them highlighting the charges and then put all the details in to a table and sent it back to them with a template letter asking for my money back.
    I have just received a letter from the customer relations officer saying sorry to learn i am unhappy with the charges to my account. It goes on to say that the complaint handling rules set by their regulator, the Financial Servicesd Authority, gives them up to 8 weeks to investigate a complaint.
    It continues to say they will respond at the earliest opportunity however they want to ensure my concerns are thoroughly investigated. Then it says if for any reason we are unable to respond fully to your concerns within the next 4 weeks we will write to update you on our progress.

    I feel they are just fobbing me of, has anyone had this problem and what should i do?. The template letter i sent for asking for my money back said they should return my money in 14 days.

  • My bank (Barclays) has decided to defend my claim in court. Has this happened to anyone else. Do they actually mean to defend or will they decide to make me an offer without actually going to court, because as I understand it they won't disclose how much it actually costs them to send out automated letters, or how much it costs them to reject direct debits, standing orders, and unauthorised overdrafts.
    Has anyone gone to court yet, or have the banks not turned up after they said they would defend the claim in court.
    Any help much appreciated. :confused:

    Here's a case of claim against Barclays reported on this site a couple of months ago. It might give you some idea of what will happen in your own case if it does go to court. Top thanks to OP showmethemoney! for her post.

    As my bank filed a defence yesterday (18/04/07) at the last minute. How long do I have to wait for a date for a court hearing.

    Just continue within your timetable. You set the time frame and stick to it. You will probably have stated a 14 day period for their response or refund. If they have not given a satisfactory response then just go ahead and send the 2nd letter and so on from there. They are just trying to delay you and make you give up.

    After all if you owed them money they would not wait just because you were busy. It is the banks own fault they are in this situation and their fault they don't have the resources to respond in time.

    Stick to your guns and keep to the guidelines and timetable set out on this website and the CAG.

    The timescale for getting a hearing date will depend purely on how busy the court is and how soon they can hear the case I cant be more specific sorry.
