    The easiest way to get your head round the mess of reclaiming interest is to simply add 8% per charge from the date of the charge using the calculator on the main article. Overdraft interest is only easily seperated when the overdraft consists purely of charges and the overdraft was incurred by a charge. The amount of interest is shown clearly on the statements then. My advice is to save yourself the headache of seperating it all any other way :)
  • after sending my letter to the bank(abbey) and asking for my statements for the last 6 years i have now recieved statements for just the last 12 months.
    i have phoned abbey to ask why i only recieved this and was given an excuse and told it would take another 4 weeks to come through. i have already had to wait 6 weeks for this lot.
    im new to this but any help would be greatfully welcomed.

    My bank account is with ABBEY.

    I have been charged 3 times at £30.00 each for 3 direct debits being paid last month that sent me into overdrawn. On my internet banking it states 'Direct Debit cleared whilst overdrawn - charge £30.00'.
    The next day all 3 direct debits were returned as unpaid due to lack of funds in my account, but am still being charged the 90 pounds for the bank apparently honouring the transactions.

    Is this allowed?
    Does anyone know if and when the banks are gonna reduce their charges?

    Older records are stored on microfiche and take a little extra time to represent for you in comprehensible form so you can either wait for them or you can complain to the Information Commissioner about the delay. They should still have given this information within the 40 days so it is a valid complaint. Your complaint will be one of thousands and isnt guaranteed to be dealt with quickly but the threat of such action to Abbey may help speed things up. :)

    Mmmmm, feeling a little worried, i am finding the whole adding interest thing a little daunting as reading a thread which stated that you cannot claim interest on charges which have been taken due to your bad spending. Is this not how we get charged in the first place? lack of funds to cover d.d etc.

    I was going to claim for interest as well but not sure if i am entitled for 1 and also thinking this could possibly throw a spanner in the works for me later down the line if i am claiming for something i am not entitled to. For me to work out what charge i am entitled to claim for interest with would be very complex as i have several charges on most of my statements which just state notified bank charges from the previous month. Please could someone advise.

    Just spoke to Halifax who confirmed that statements were sent out to me yesterday after requesting them 2 days ago....Mmmm i wonder, for once i am actually excited to see the postman coming to my house!!

    For as long as you continue to have direct debits active on the account and no funds to pay them they are allowed to charge yes. As you are aware though you can reclaim them to be credited to the account and bring your account back into the black. To end the practice of charging and the merry-go-round of reclaiming obviously you can cancel the direct debits or put money in the bank to cover them.

    I dont know when they will reduce charges. The OFT report was assumed to have been of some influence on the amount and it is delayed now so is unlikely to change the amount, if at all, for some time yet.

    I posted this a little earlier in the thread on this page but it bears repeating with a slight amendment to answer your question.. The easiest way to get your head round the mess of reclaiming interest is to simply add 8% per charge from the date of the charge using the calculator on the main article. With regard to charges for your own 'bad spending' this would really only apply in the case of an overdraft that you incurred yourself. You would need to seperate the interest charged on the amount you were liable for from that of charges.

The amount of interest is shown clearly on the statements then. My advice is to save yourself the headache of seperating it all any other way and just use the calculator to assess 8% per charge per date and have done with it. :)

    Claimed £3666.68 (inc interest).

    Offered £2600. Accepted as part payment but proceeding through court for the rest.

    MCOL passed papers to local court. I completed Allocation Questionnaire and sent off to local court with further £120 on 4th April.

    Can anyone tell me who has been at this stage with HSBC, what happens now? How long will court date take to come through? When will HSBC make me another offer?

    I have received two letters from Citicard bot stating that they have no intention of refunding any of my charges!! The first letter was in response to my claim for 100% of the charges and the second in response to my offer to accept these charges less £12 a charge. I indicated that I would instigate legal proceedings and they responded 'Whether you decide to institute court proceedings or not is entirely a matter for you".

    I am now proceeding with MCOL but would be interested to hear whether other Citicard claimants have had the same response and what the eventual outcome was?:mad:
