I have had the same notified charges from the halifax it is when they have returned cheques or you have gone over your overdraft limit. they are supposed to send when they return a cheque or go over your overdraft limit and usually in the letter they say at the end of the month they will cahrge you the fees. Then when they appear on your statement they appear as notified charges. But they don't always send the letter!!!!!!! as I have found out I didn't even know I had most of the charges.My Mission today is to have an opinion on everything.

Thanks for your response to my queiry Twinkly, I cant find the letter you have recomended through the link, i am having trouble navigating the sight, i am not only new to this sight, I am new to this internet stuff as well so dont quite know what i am doing yet.Is there anything you can recomend i could add to the template letter explaining that Iknow they have done the wrong thing by taking charges out of my benefits. any advice from you will be greatly welcomed. thanx Debixxx

If you add the section:
Social Security Administration Act 1992
Miscellaneous
Certain benefit to be inalienable **
187- Subject to the provisions of this Act, every assignment of, or charge on-
(a)benefit as defined in section 122 of the Contributions and Benefits Act;
(b)any income-related benefit; or
(c)child benefit,
and every agreement to assign or charge such benefit shall be void; and, on the bankrupcy of the beneficiary, such benefit shall not pass to any trustee or other person acting on behalf of his creditors
Then I would simply and add a line to the effect of :'As we are both aware, you may not apply charges to my social security benefits by law and such charges are subject to refund.'

Yes. The claim is ongoing until you file at court and subject to any changes you wish to make as to the amount. Its helpful in that you can also correct any mistakes as you go along. Once the claim has been filed i think that is the point where you stop adding although I have read that if you make an error at court stage there is a way to correct it. I dont know anything about that in detail though sorry. I also believe that if any charges are added whilst going through the court process then you can always negotiate with the bank for them if they offer a settlement before judgement.
If judgement is entered by default and you dont have the chance to add such charges or negotiate them there is nothing to stop you making a further claim for that time period, starting the process again.0 -

Hi, I am in the process of requesting unlawful bank charges from my bank the Halifax. I have sent letter requesting refund of bank charges and on the 14th day of my letter being sent out, i recieved a lettter back from the halifax saying "The financial Services Authority, gives us 8 weeks to investigate and respond to complaints" what I want to know is can i send out my letter advising the Halifax i am taking them to court on Monday this week, which is exactly 14 days after sending out my first letter or do i now have to wait 8 weeks before i can do this??? Many thanks for your help in this matter.0
