    I've just realised I've made a mistake on my 1st letter asking for my bank charges back!! Stupid me had put the wrong date....well....the wrong year! I've put 2006 instead of 2007!!!! will this affect my claim in any way? I could kick myself :o :mad:

    Does anybody know how mouch more I would have to pay if a court date has to be set ?please!! The money claim online has already cost £80

  • I've just been reading teletext and Which? are stating that 85% of people reclaiming bank charges have been successful, and there are still over 65% of people who have yet to try!

    Let's hope they don't all try at once and slow my claim down!!:mad:

    Both my Bank account and credit card are with Lloyds TSB. Will I have to send off two seperate letters asking for my 6 year data, with two seperate £10 postal orders?

    Everyone is entitled to refund and the only people slowing it down will be the banks. Direct your anger at them.

    The situation will not get better, it will get worse. If your claim is delayed as a result of someone else claiming money that is rightfully theirs then the banks are the only ones to blame in this whole mess for taking the money unlawfully in the first place.

    I hope more people do claim and force the banks to realise they just cannot win this one this time around. Perhaps the complete clogging of their systems and orders against delay from the Ombudsman or a completely frustrated and overworked judge will put an end to this once and for all. Perhaps we would see true costs announced and refunds will be made automatically across the board.

    One can but dream eh ?:confused:

    No just send one letter and one postal order quoting both account numbers.

    In exact relation to your case however Acknowledgment of Service does not neccessarily mean they will defend it just gives more time for them to file a defence. Effectively it delays things if they have no intention of filing defence and serves to intimidate the claimant.

    Relax for now until a defence is filed. From then the Allocation Questionnaire fee is £100 for claims over £1500. If you are on certain benefits you can apply for exemption of costs.

    There is a box on the acknowledgement of service form that says 1, I intend to defend all of this claim and there is a cross in it.
    We were refunded in july after letter 2 £379 this was half of what we asked for but we did sign the( in full and final settlement form) last december we asked for all statements going back 3 or so years and deducted the refund we had last july from ALL charges made since opening the account in 2004 to feb 07. We then asked for this back they said that they we had previosly accepted, in july 2006 a payment in full and final settlement of your complaint regarding bank charges on your account. At that time we advised you that any fiture charges would stand,therefore I am unable to agree to your request for a further refund.
    Then they advised to refer to the ombudsman if we were still unhappy,well we were very unhappy so we started court proceedings straight away.
    Surely they cant get away with bribery and that there cannot be a full and final settlement when the charges are considered unfair by the O.F.T. We do appreciate you opinion on this So what do you reckon they will or wont do? we are really hoping we dont have to go to court.

    Well thats good to hear, thanks Twinkly. This may sound a stupid question, but is my credit card account number just the long number across the card, and do I need to include my sort code with my current account number?

    I honestly do not know what the OFT or the court will make of the 'full and final ' settlement. I would read the letter you signed accepting it and note carefully how they have phrased things in it and exactly what was accepted by you IN WRITING. It would help me to help you to know exactly what was in it if that is possible ? If you dont have a copy of their letter request one by return of post.

    Sorry I cant be more helpful at this stage but personally I tend to be very very pedantic about things and will argue validity of points in correspondence with banks.

    Perhaps someone else may be able to comment further but I would need to know your exact situation with regard to that acceptance letter and will certainly help further when I know :)

    Edit: With regard to the legality of the term 'full and final settlement' it is open to some dispute in certain cases apparently. I read up here and came to that conclusion : http://www.eoc-law.org.uk/default.aspx?page=2735#full

    Again, it depends on the full wording where the term was used.
  • Hi all,

    This is the first time I have posted here, but I am about to start claiming back all the charges from the bank & credit cards and would appreciate a little advice - apologies if it is already stated somewhere here, but I've tried looking all around (and boy is there a lot to look at!!) and can't see it anywhere!!!

    My partner and I have, between us, 3 accounts with Natwest. A sole account each and a joint account in both our names.

    Will I need to make a seperate application for each of these 3 or can I write one application for all 3 accounts (presuming I guess that my partner also signs the letter)?

    Thanks in advance for any advice you can offer.

    There are some great stories, and some great advice on these boards and I have finally plucked up the courage to start claiming this money back - after months of being too scared that the bank would foreclose on a loan I also have with them!!!
