  • Maybe so however, the fine could be reduced based on his employment/financial circumstances. Alternatively, they could go the other way (as you have pointed out).

    The fine/penalty part of the problem is going to be inevitable - be it 1) A fixed pen/fine 2) Court pen/fine.

    We can possibly contest this at a later day. However, the issue for the time being is getting his car out using the cheapest way possible and I believe I can do it as per my previous notes.

    You have nothing to contest with regards the points. No instance is an absolute offence. His only defence would be had he been driving a vehicle owned by his boss.
    The boss himself was turned away from the police/compound as the documentation revealed he himself forgot to register the vehicle owner as the business name.

    The bosses policy covers under the following conditions:

    1. The vehicle is owned by the business
    2. The employee is a named driver on the policy

    In this case, condition 2 is true but the first is not. The registered keeper/owner of the vehicle is my brother. The policy/cover is invalidated as both conditions are not met.

    So the only choice he has, is to find temporary cover. However, rather than using the merchants wanting a fee of £350 - 500 for 30 days cover, we are being a little clever by obtaining insurance (that includes a clause about the recovery of a seized vehicle) and using the cancellation period to cancel once the vehicle has been retrieved. Bit messy but its £150ish versus £350 - 500.

    Yes for his ongoing insurance quotes that may be true however, for the purpose of releasing is vehicle from the compound, the cover will be low.

    Good point.

    Personally, I agree with you. He has no leg to stand on with respect to the points. He will just have to deal with it and learn from this lesson to not try and cut corners.

    That said, whilst he doesnt have the points, he should get cover for the sole purpose of getting his car released.

    Sorry, I've decided the police in this country are a joke and they completely rip of the community through cheap nasty tactics like this. The following makes me very angry and really makes me want to verbally abuse them in the street. I am so riled and fuming right now.

    1. Operation Wolverine, DOES NOT accept a FAX or Email for a valid certificate of motor insurance. They require the original document ONLY.

    2. Operation Wolverine has a number, which I have been calling since Friday and of the 100 times I have called them (different times and I mean 100), the system always goes to voicemail.

    3. The voicemail tells you that someone will be in touch within 24 hours however, it has been over 72 hours and I have heard nothing.

    4. You cannot turn up to the station with your documents without making an appointment, which can only be made by calling the number stated above, which nobody answers.

    5. Every 24 hours that passes, my brother who is going to be on Job Seekers allowance, lose £20 per day.

    These blue ****** ******** ****** are a bunch of robbing ****** who are quick to seize vehicles but take the **** allowing someone to recover them in an effort to rack up the costs and deter you away from recovering the vehicle. This is a perfect example of how the police use legal channels to con you therefore I have no shame or regret in wanting to do the same.

    My mate works in the force and he is a great guy but I have lost alot of respect for the police. Absolute joke of a service.

    The pound tells you that you have to produce the documents at the Operation Wolverine department. Once approved, I go to the pound and get the vehicle.

    3. You then go to the pound and release your vehicle.

    Prior to learning this, I had much respect for "our" boys in blue. After this, I seriously wanna spit at them.

    Precisely for that reason. He is an idiot.

    Don't let the "I" confuse you. I am at work and I am typing away on the fly so it it may come across like it's me but trust me, it aint. My lovely Yaris is parked up safe n sound outside.

    But for us at least, family is family and we always back each other up no matter what. He does not have the intellect to think on his feet so where he falls, I or my other brother fills in. Just the way it is.

    But he will learn from this and he will be paying me back. So many times he has let me down but he gets a harsh dressing down and he usually learns until he coks up again with something else.
