    The fine/penalty part of the problem is going to be inevitable - be it 1) A fixed pen/fine 2) Court pen/fine.

    We can possibly contest this at a later day. However, the issue for the time being is getting his car out using the cheapest way possible and I believe I can do it as per my previous notes.

    There is nowhere in any online quotation that I know of that requires information requiring pending points. I have also rang the insurer on his behalf and similarly, the question regarding pending points does not exist. What does exist, is point that ARE on the license.

    I believe the reason for this is because the word PENDING is a term that is not absolute, meaning, the points/fine situation could be contested and possibly avoided depending on the case put forward. Therefore it makes no sense to shoot yourself in the foot at this time to mention something that is 1) Not Absolute 2) Not on the license and 3) Something that COULD or COULD NOT happen.
  • By the way, just got a quote from an underwriter for 30 days temporary cover - £415!!!! Baaaaaaaallz.

    Insurance, release, cancel within 14 days will be approximately £150 including the cancellation admin fee.

    This could get the vehicle released for free.

    The boss himself was turned away from the police/compound as the documentation revealed he himself forgot to register the vehicle owner as the business name.

    The bosses policy covers under the following conditions:

    1. The vehicle is owned by the business
    2. The employee is a named driver on the policy

    In this case, condition 2 is true but the first is not. The registered keeper/owner of the vehicle is my brother. The policy/cover is invalidated as both conditions are not met.

    So the only choice he has, is to find temporary cover. However, rather than using the merchants wanting a fee of £350 - 500 for 30 days cover, we are being a little clever by obtaining insurance (that includes a clause about the recovery of a seized vehicle) and using the cancellation period to cancel once the vehicle has been retrieved. Bit messy but its £150ish versus £350 - 500.

    So your brother was never covered.

    How about getting the money he paid for insurance back off his boss to get the car out?

    EXACTLY!

    That is exactly what he is doing once he gets the car out. I am going to pay the deposit for the temporary (under 14 day) insurance cover. This will be much quicker to execute versus going to the boss, waiting for a convenient time to go to the bank, drawing the money out etc all whilst he is being charged £20 per day for storage costs.

    Once the car is out:

    1. He sell the crap punto
    2. Recovers the Insurance Costs
    3. Buys a legit car and use the costs recovered to cover his new motor.
