Will expect the next post to be they released the car with no fee and no charges and gave us £1,000,000 compensation and allowed to drive uninsured whenever I like because its not my fault its society.

    Blah Blah Blah.

Listen mate. I abide the law. There are many things I pay for (or follow) in this country that seem unfair (to me) but the law of the land is the law of the land and I abide by it.

Now, the same principal applies to businesses too. If I find a way to legally get his car out without having to fork out £410 for 30 days temporary cover, then I will use my intellect to do just that. There is nothing malicious or illegal about. In fact it is pretty similar to how MSE works - discovering loopholes for positive gain. It cant work one way and not the other. I am sure you have had your fair share of luck so please dont go there.

In my brothers case, here is the breakdown of costs I was expected to pay for the release of the vehicle:

£290 - For the release of the car from the compound
£410 - For temporary car insurance for 30 days

    Total = £700.00

Here is what I did for my brother:

    - Did a Moneysupermarket quote online using the correct details and got quotes between £3 and 4000.00

    - Added my mother as a named driver to the quote and changed his Job Title to voluntary worker (which is true but I cant be bothered explaining) and got it down to £2-2500.00

    - Then read the policy documents for the top 4 quotes found - Admiral, Elephant, Privilege and Churchill

    - Of the 4, I found only 2 that mentioned a clause regarding the recovery of a seized vehicle (read back a few pages). The two companys were Churchill AND Privilege. I went with the cheaper of the two....ohhhhhhh yes!!

    - We chose to pay monthly and I put down a £500 deposit using my credit card. I took this insurance out with them yesterday evening.

    - When asked (in the online quote) if I had any motoring convictions or points now or in the past 5 years - I said NO.

There is no wording regarding PENDING convictions.

Also, let it be noted, that my brother did not receive a FPN nor any notification of an IN10 or pending prosecution.

    - I checked AskMID this morning and the car was insured - bonus!! This process can usually take between 24 and 48 hours.

    - I called up the insurer this morning and said:

"After taking out Insurance cover with you yesterday, I read your policy document and needed to let you know that my car is in a compound but I have had no FPN nor any documentation relating to any pending convictions. I also contacted the DVLA who have confirmed my license is clean. At no point during the quotation process did it request any of this information however, I am doing my duty :rotfl: by letting you know so that you can put a note on my account".

    - The representative said Thank you, added the note and mentioned that I did the right thing. However, when any information relating to any convictions comes to fruition, I have to let them know.

    - I went with my brother to the Police Station 30 mins after this phone call and explained the situation to the desk officer. The officer was a little concerned about us not telling them about the pending conviction and warned this may result in failure but ultimately it is not her place to say and left it in the hands of the insurer. Although she felt it was wrong, she said we were technically correct.

    - To make things worse, my brother was requested to bring with him his V5 logbook and Proof Of Purchase of the vehicle or contact information for the previous owner. Guess what??? He lost his f***ing V5!!! and to top it off there was no receipt of sale!!

    - A little technical skill was involved in pulling my tablet out and tracking the previous owner online via my mobile hotspot and by doing so, I found the full name, address, DOB. (Be warned people, the internet is a scary place where details are flying around for those that know where to look). A little charm was required to convince the officer to accept other proofs present and run a PNC to find the registered keeper details. Sorted! :j

She went away and returned an hour later.

    - "You can breathe. You went with the right insurance company. I know Admiral and Elephant would have voided or rejected the policy but Privilege were fine" :money:

    - Got the car out of the compound, parked it on the drive, called the Insurance company and said

"I lost my job this morning and I dont think I can afford to pay the premium, please can I cancel".

"Off course it is sir but you will be required to pay an admin fee of £26.50. We will refund you the £500 less the admin fee".

My response: "Ohhhhh no. Do I? Pshhhht, Ok then!" :rotfl:

    HAHAHAHAHAHAHAHAHAHAHAHAHAHAHAHAHHAHAHAHA

    :rotfl::rotfl::rotfl::rotfl::rotfl::rotfl::

I know it pains you (FORGOTMYNAME) to hear this but it makes me even more happier knowing that it does, I ended up paying the following:

    £290.00 + £26.50 = BING, BANG, BOSH.

    Total Paid: £316.50

GOOD AFTERNOON, GOOD EVENING AND GOOD NIGHT.

THANK YOU TO ALL YOU POSITIVE MSE'RS!! X :money:

I can't gloat this much so Ill be nice and give Forgotmyname a kiss too - X. On second thoughts, I will gloat! You can keep that kiss (but you know what your kissing mate).

P.S. I ALSO GAVE THE YOUNGEN A BAD ROASTING ON THE WAY HOME TO THE POINT HE WAS ALMOST CRYING. HOPEFULLY HE LEARNS FROM THIS AND DOES THINGS THE LEGAL AND PROPER WAY.

Erm, you used the loss of a voluntary job to cancel the insurance? Okay then!!!

    Anyone else smell horse manure?!

On the subject of police powers to seize, it is worth remembering that we only have powers to seize vehicles that we believe are used uninsured or driven by an unlicensed person. If we only suspect uninsure/unlicensed, then we mustn't seize it.

The court interpretation of 'believe' is 'to be almost certain'. That requires more suspicion than merely a 'no show' on the Midas database.

The reason I say this is that if the circumstance ever arose where you knew you were insured/licensed, and the police had a level of suspicion that you may not be, and were considering the seizure of your vehicle, respectfully ask them to explain what raises their level of suspicion to belief. You might be able to encourage the officer to accept that his suspicion does not actually amount to belief, and the matter could be resolved by way of production of your documents at a police station.
Thank you for this. Very helpful information.

In this situation, that post is of no use to you.

They suspected he had no insurance and they were correct

I suspect the op was only acknowledging the post as it was intended, ie for future information only.

    Anyone else smell horse manure?!

As i said I couldnt be bothered explaining but he had 2 jobs

    1, Delivery driver
    2. Voluntary worker

The 2nd was the predominant one. The first was part time and the one he said he had lost.

The reason why you smell horse manure is because you need an explanation for every tiny detail and are so quick to jump on your high horse.

    Do one you nayyyyyyysayer.

But some people just wanna talk makka and peppers.

All the haters are out and hating me as they do toward a lot of people on here.

I hope someone finds this thread helpful.

Massive shout outs to the people who showed an unbias view on this.

    Good bye.

I've contributed on a few police forums over the years, and I've often had to remind some officers on these forums that we need to believe, not just suspect. If greater awareness of that from both sides led to less motorists being unnecessarily inconvenienced, and maintained the integrity of the power, that's got to be good.

    Let them crush the car.
He doesn't deserve it, and evidently won't be responsible for it.

Traders policys are FRAUGHT with danger. Far too many times I've stopped young lads who assume they're insured because they make their dad a cup of tea in the garage on Saturdays. Then you phone the underwriters and explain the circumstances and you hear the tutting and the shake of the head and "of course that's not covered".

Trade policies are now so tightly worded that in short, anyone with one who is reputable will NOT be allowing people to abuse it in case it gets taken off them and their operating costs sky rocket.

The days of "Trade policy mate, I can drive what I like" are long gone.
