    I am feeling frustrated on behalf of the OP!

    If somehow Paypal decide to refund your money (by some miracle), what would happen if the so called 'buyer' have cleared their paypal account?

    Only problem is I charged for special delivery but sent the E900 via 1st class recorded, will they blast me for this?

    I sympathise with your plight but does no-one else see the wrong in this?
    Charging for Special and Sending Recorded.... So who ripped who off??

    Apologies, I'd forgotton that from earlier in the thread and just assumed that due to the item it was sent special. In that case I think the OP is going to have virtually no hope of getting anything from anyone, the wrong postal method used and no signature obtained.

    I can see your point, but the op has already explained that the reason for the Recorded and not SD was because his/her brother took it to the PO and didn't understand the difference and sent with wrong type.....

    besides which the issue is not really how he sent it, but the fact that paypal have taken his money for goods he has supplied and has proof that it has been delivered.

    He does not however have the proof in the format that paypal require, so as far as paypal are concerned he does not have proof. Special would have given consequential loss insurance, recorded does not, and I think that means the OP has lost out due to his brother accidentally using the wrong postage method.

    Fair enough, if thats the case.
    Shame though, as I would doubt sincerely that they will get even a penny back from Paypal.
    Its also a shame that Paypal reversed the transaction before it left the account.

    .... I agree entirely, I'm sorry to say. This is where self-responsibility comes in, and an acceptance that this situation would not exist if the item had been sent within Paypal's terms (and the level of insurance which was charged for). Wherever the mistake was made with the delivery method is neither here nor there... the mistake was made, and Paypal have terms and conditions to ride over this one as they see fit. The T&Cs are horrible, but it would take someone with 1000x more money than I have to challenge them.

    I can't see a way the OP can get a refund from anyone other than their brother, unless the Royal Mail extend a goodwill gesture, seeing as they messed up too in a small way. I guess that would depend on what is claimable under Recorded Delivery - I suspect not a lot.

    I would still be tempted to persue Royal mail, after all if they claim it has been delivered why can't they update the online tracking. If Royal mail would update the tracking to show quite correctly that this has been delivered then the OP has a case with paypal again.

    I am at a loss to understand why Royal mail are able to provide proof in a PDF format yet not on their tracking page, that makes no sense at all and I wonder what is really going on with RM?

    I would be inclined to believe the buyer its hard to believe that a scammer would fold at the first mention of the police. It could be that he owed paypal money either on that or another account.
  • thanx everyone for your responses, but here is the final and most bizarre twist of all! not gonna tell you what happened in the end yet, read on for that, but its worth reading! here goes:

    whilst still arguing with paypal that the service used was a paypal recommended service and its not my fault the delivery is not confirmed online, I also sent a nice message through eBay to the buyer asking why he'd chargebacked, the response was 1st:

    [FONT=Arial, Verdana]now I thought this was odd, never had I heard of this before, maybe the buyer was just using excuses to pretend that they hadn't performed a chargeback or paypal complaint.

    a few days later i sent another nice message explaining that royal mail had provided me with both an electronic and printed version of the proof of delivery with the recipient signature and time and date of delivery, therefore should I not receive my funds I will happily walk along to my local police station.

    the response from buyer? here it is:

    I'm sorry about all this. Paypal reversed the payment I sent to you because of some money I owe them from a couple of years ago, but they aren't making it easy for me to pay them!

    [FONT=Arial, Verdana]now, on the one hand paypal are claiming that this was a chargeback and i'm still arguing with them with no luck, on the other hand this guy is saying something different, but the fact remains that at this stage I am still out of pocket to the tune of £115, so I reply telling the buyer that whatever his situation with paypal, he has the phone and i have the signature to prove it, and he should pay me via another method, preferably bank deposit, giving him my sort code and account number and name in full. I also tell him that should paypal suddenly pay me the £115, unlikely as they've already decided in his favour i will gladly refund it. The last thing i mentioned was that i had a similar situation last year with another buyer and got my money back with the help of the police (completely made that up!), but I'd rather not go down that road again!

    so this morning i get the following:

    Paypal have finally given me the money back, so I'll get that paid into your account today.

    [/FONT]27 APR CR PAID IN AT 400943 115.00

    hmmm, the guy has walked into a HSBC branch and deposited!

    now either the buyer is telling the truth, or it could be that when i politely threatened to go to the police he !!!!!! his pants and decided to pay me, either way i have now got my money, so all is well that ends well!

    i will still give an ear bashing to paypal, will also get onto the sorting office closest to the buyer and ask for the person in charge to give the postie a right telling off which they deserve.

    last but not least, some people have mentioned that its really my fault that the item wasn't sent special, true, but then again, if the postie doesnt collect a signature properly then it doesnt matter how you send it!!

    the buyer signed for a special delivery item at the same time he signed for mine, guess what, that confirmation doesnt appear online either!
