    forward your email to who ever at paypal is dealing with it as then it will show that the RM sent you the original email .
    Baby Thomas born 3 months early by emergency section on 21/1/09 weighing 1lb 15ozs .
    Thomas came home after 3 months and 2 days in hospital weighing 5lb 15ozs
    Thomas weighed 21lb 4ozs on his 1st birthday , a total weight gain of 18lbs 5ozs !

    so much for seller protection, there is NO seller protection, I have a copy of the !!!!!!!s signature who received the phone, it matches the eBay ID, i'm taking this to the police if paypal dont get back to me within 3 days.

  • Here's their reply to my email in which i sent them the proof of delivery:

    Dear Khalid Mumtaz,

    Thank you for taking the time to contact us with your concerns. I am
    happy to assist you further.

    I apologize for your frustration in this matter, and assure you that no
    report of fraudulent activity through our service is handled lightly.
    When you signed up for a PayPal account, you stated that you had read
    and agreed to our User Agreement and all of its terms.

    A primary part of our User Agreement is our Seller Protection Policy.
    Our Seller Protection Policy is very specific as to the guidelines the
    seller needs to follow in order for a transaction to be covered. Any
    time that a seller decides to work outside of the realm of these
    guidelines, the seller assumes the risk of not being covered by Seller
    Protection.

    I'm sure you understand that we cannot keep our sellers from wishing to accept a risky business transaction. We have taken several measures to protect our sellers from possible fraudulent transactions; however, the decision to accept the transaction is ultimately up to them. We regret that you have had this experience.

    seems to me that they are just washing their hands of any guilt, ridiculous!

    just because the signature wont appear online, they are refusing me access to my funds, even though I have sent them the pdf Royal Mail sent me.

    As they've accused me of operating outside of the guidelines I've just replied asking for clarification of exactly where I have not followed their guidelines. Lets see what they reply with this time.

    Frankly it looks like Royal mail have a lot to answer for here, might it be worth going to PostWatch (or whatever they are called this week?) to make a formal complaint that an item you sent which RM themselves have confirmed was delivered, cannot be proved as delivered by you for paypal purposes?

    If Royal mail had done their job properly and showed it as delivered online then you would win the paypal chargeback. Therefore Royal mail are directly responsible for your loss, and should be made to set the records straight or pay out compensation to you.

    If this happens regularly with Royal mail it will basically mean that none of us can ever send anything safely using a Royal mail service.

    stupid royal fail and their stupit delivery personnel, all they need to do is stick envelopes into a letterbox and collect the odd signature, but they cant even manage that properly!

    I wish I knew! they just don't explain that, always get around it by dishing out some random text from their terms and conditions which doesn't even apply to me!

    I'm guessing its cos the signature doesn't appear online, but since I've emailed them the pdf file Royal Mail sent me, I cant see what their problem is :confused:
  • Might be worth threatening Paypal with a county court claim. You can prove delivery. Paypal has no right to refund the buyer when you can prove the item was delivered. You sent it via a Paypal accepted trackable method, as per the seller's protection policy. It's not your fault that RM messed up. Another option would be to report PP to the financial ombudsman.

    I think the problem here is that strictly speaking Royal mail have messed up and the OP cannot comply with paypal's terms and conditions.

    To prevent a chargeback the item must be tracked *online* and show as delivered, in this case it does not. The OP can supply a PDF file, but paypal will not accept that, which is sort of understandable as if item has been received then it should show so online, and anyone can fake a PDF.

    I still say that this is entirely down to the Royal mail, if they can supply details in a PDF why on earth can they not provide it online which is the service the OP paid for? I would be persuing this very stronly with the Royal mail, special delivery covers consequential loss, so claim that and fight it out with them.

    ... Paypal have this in their T&Cs. They can wash their hands of it. "PayPal reserves the right not to dispute a chargeback even if the seller has provided some evidence, particularly if PayPal believes the dispute is not likely to be successful. "
