And it seems that you could appeal to the PPC stating, say, 10 different legal reasons why you shouldn't pay their fake PCN...but then once referred to POPLA you are then stuck with 4 biased boxes.

In theory (and this is me being obtuse on purpose for discussion not because im a ****) the only people who are not adhering to the EA are you guys. Sure i know you aren't an organisation but you are advising people to appeal to a service which they cannot use. The reason they cannot use it is the stance has and is the same. Ignore.
You by way of requiring them to appeal to POPLA are being unfair to them.

It remains to be seen how POPLA will treat such appeals, but if they ignore legal arguments, it puts the driver in a stronger position if it subsequently went to court.
I have been providing assistance, including Lay Representation at Court hearings (current score: won 57, lost 14), to defendants in parking cases for over 5 years. I have an LLB (Hons) degree, and have a Graduate Diploma in Civil Litigation from CILEx. I think ignore remains the preferred option in most cases. If you are the keeper but not the driver, you may be better off informing the PPC.
Whether you want to use POPLA is up to you, as long as you realise the chances of success are minimal.0 -
Yes, but the fourth one "I am not liable for the parking charge" gives plenty of scope for adding reasons why you are not liable - contractual penalties, tenure of land, breach of Equalities Act, breach of UTCCR, etc., and if you are not legally liable, then you are not liable.
It remains to be seen how POPLA will treat such appeals, but if they ignore legal arguments, it puts the driver in a stronger position if it subsequently went to court.
Will hopefully be testing out the legally liable option in a few weeks:)For everthing else there's mastercard.

So:
- I complained to London Councils about POPLA's website
- London Councils replied that they had forwarded my complaint to POPLA
- I replied to London Councils pointing out that POPLA's website directs complaints to London Councils
- London Councils have now replied that they can take complaints about POPLA, but in this instance they felt it was best handled by POPLA as it might require amendments to the POPLA website.
So there ya go. If I get no reply, or an unsatisfactory reply, from POPLA I shall be straight back onto London Councils demanding that it goes through their complaints procedure.
Anyone who has already got the brush-off from POPLA might wish to do the same.
If London Councils get enough complaints about their b@stard offspring they might kick some a**e themselves.Je suis Charlie.0 -
