    Ive spoken to my mums boss about it and she pretty much agrees with you all. My neighbour should not be parked there. Also the house on the end have taken the land without permission. Im going to sort up a meeting with the local highways team (rang today but they were closed) she said chances are they wont change the garden/kerb situation but they will highlight the fact she shouldnt be parked there. Then im going to knock her door explain whats happened and the options are we either sort it amicably by her moving down and back (shed still be infront of her garage) or if i absolutely have to i will park there everyday and if she blocks me in i will have no choice but to phone the police everyday. I do not want to go down this route as it puts everyone out and wastes police time but if i have to do it, i will.

    I (unqualified opinion) think it means you have the right to park outside your garage, but your neighbour only has a right of way over the space in front of theirs. Their red line is only the garage itself, with arrows indicating a right to pass and repass.

    You can only take adverse posession of a property after 12 years via the land registry. Until then you're either trespassing, squatting or maintaining the property.

    Adverse possession is the term used for when you legally take it over. In your case it would be 2019 (it used to be 10 or 11 years but was upped a while back to 12 if memory serves).

    Well basically it's part of a block of garages. The door had been ripped off it's frame and was rusting away inside. The frame was rotten. It was also full of bald tyres, random junk and a mouldy mattress full of used needles.

    The land registry said it didn't exist, and other investigations I made to find the owner came to nothing, so eventually I just disposed of the contents, had the door replaced with a brand new one and started parking my car in there (this was the main reason for doing this, I was sick of the car being broken into). When I moved from the area I left a bunch of stuff in there which, as far as I know, is still there.

    As far as I'm concerned I haven't done any criminal damage, if anything I've improved it!

    OP you have an interesting problem.

    Have you tried speaking to any long term residents in the road. It might help to know when your neighbour has acquired possession of this extra garden space. Judging by the size of the conifer bush its probably longer than 5 years but some local might remember when this change of use occurred.

    It does need unlikely to me that the pavement on one side would have a dropped kerb and the the one on your side does not. The Council should be able to tell your if its supposed to be a dropped kerb or not. If they are not cooperating try writing to your local councillor or MP about the matter.

    If it was a dropped kerb, it was a long time ago, as the road tarmac up to it is intact in the photo. What's it looking like in real life?

    Looking again at her plan, the red arrow leading to 'A' must be mentioned in her deeds as a right of access. Look for something that mentions the garage and access to 'A'.

    And then compare to your deeds to see if there is anything similar in yours.
  • I get on well with someone who also parks out the back and he used to rent my garage of the previous previous owners. He said its been like that since he moved there in the 80s. Im pretty certain the council wont install a dropped kerb so its looking like im going to have to talk to my neighbour about helping each other out. Her helping me by letting me get in amd me helping her by not reporting her everytime she blocked me in.
  • i wouls ask her LL if the garage is part of her tenancy agreement, i say this as my wifes sister has a garage to the rear of the house but as part of her tenancy its not part of it, as the owner retains it to store his property in, as this garage is not part of the house the LL may not have given her permission to use it and retains it forhimself as a lock up.

    i would say in thi situation, the person who owns the house next to the garage, has assumed ownership of that little patch to extend his front lawn area, and as such moved out his boundry, to widen the rear access lane he has to the side, this may not be the present owners work, but may infact be the previous owners work and the current owners are none the wiser. the concreted area infront of the wall with yellow signs on maybe a drop down for all owners to give you the space needed to get in and out for access to your garage, it seems strange to me that the land is yours to the front of your garage but others have access to and from over the land, it would make sense if the 2 garages next to the wall with the yellow sign on had ownership and then the rest upto your garage had access only as this would make it simple and straight forward and have no issues like your experiencing.

    the issue your neighbour has is if she has specifically been told by her LL or the management company that that is her own personal parking space with garage, then she's not being deliberatly awkward its just she thinks she has the right to park there and will park there, and may feel awkward about parking infron of others garage without an agreement.

    asking people who own these garages to have a get together maybe the way forward as all will be able to say yes fine drop down i dont mind and issue is then sorted.
