    ive phoned the DWP again and they went through my claim with me (which is now on there computers) and said I am entitled to CB ESA so thanks to all the replies but it seems the money is mine and mine to keep.

    Glad it appears to have been sorted.

    Hopefully the last thing you asked them to do on the phone was to confirm that in writing so you have something to produce if it is queried in future.
