    Something is clearly wrong here.
You speak of having an income - have you had this income all the time you have been claiming? You mentioned PHI in an earlier post and you seemed to be paying tax on this.
Have you had savings over the permitted amount all the time you have been claiming?
It looks as though you should be following the advice in post 2 - at some stage Audit will catch up with what is going on and you may find yourself with a large bill.

post 2 says phone them i already have and they didnt help much they just said your claim was rebuilt on the 15th but no money has been paid she was quite sure that no money has been paid to me since april to the point of saying i must off been mistaken when reading my statement and the monet was not from them. and yes the income is from the PHI which i now get and it was the back dated amount that put me over the 16 grand.

    Your posts are confused.
If you have 'been recieving IB-ESA for 4 years', you are certainly not entitled to CB-ESA, or CB-JSA.
If you have savings of over 16K, unless you came into these suddenly, you will have had a considerable overpayment while these savings built up.
hi roger cant you go from IB to CB

    Certainly.
But to do so you would generally need to work significantly in two tax years, and you can't do that on ESA.

    no you cant.

you will always be assessed for contributions based first, and if you dont have enough NI contributions, you will then be assessed for income based.

where did you think new NI contributions had come from if you had already received income based. surely you know if youve worked in the past 3 years and paid NI?

    were you transferred onto ESA?
had you been on ESA for a year in April?

if that is the case you would have stopped receiving cont based ESA after 1 year ( came into effect april of this year)

your income means you wouldnt be entitled to income based.

so you really need to find out what this money is as you dont appear to be entitled to it.
at some point they will work out what has happened and they will want it back .... so dont spend it!
