don't know where moneys come from

    Then you write to the BDC as follows:


    My benefits were suspended in April because I have income of £..... from X source(s) and also savings of over £16,000.

    However, a sum of £806 was credited to my bank account ( number/sortcode) on X date. My bank advised that this money came from the DWP.

    Subsequently, other payments (see details below) under reference NI number, DWP/JSA have been paid into my account and continue to be so paid.

    I have not claimed JSA and have received no letter of explanation from the Department.

    I visited the job centre at .... on..... and spoke to ..... about these payments but the clerk was unable to provide an explanation.

    I telephoned the BDC on ... and .... and spoke to a supervisor Mr Y
    but he, too, was unable to assist.

    Please investigate this matter and advise me in writing of your decision as to whether this money is being correctly paid.

    Or, you just say screw it, you've tried to notify them, and stick the cash in an interest bearing account, so at least you get the interest.

    lol... or go to the police and say you think your bank account is being used to launder money by a criminal enterprise calling itself the Department of Work and Pensions. Joking aside I do sometimes wonder if next time he is on phone to DWP if he tells them if they don;t sort it out he will contact the police to investigate the suspicious activity regarding monies going into bank account... that should smooth the processes of investigation a little.

    got another payment in my bank today and on the statement it say EESA so its now changed from JSA. back to ESA strange. the amount it £210 every 2weeks would this be the main phase or the assesment phase.

    210 is a single person in the support group.

    This is what I don't understand with all this ESA stuff, I'm in the WRAG on contribution based ESA and I get £210 a fortnight, so why is it the same as the support group? And I'm not single

    I may get shouted at for this post.... but if the OP has notified JCP of all changes to his circumstances (eg savings, earnings, other income etc) and JCP have paid him in error then whilst JCP can ask for it back they do not have an automatic right to it back.

    Having said the above the OP needs to establish what these payments are and why they are being paid.

    This is incorrect.
    They do not have an automatic right to it back - only if the claimant does not think it's being incorrectly paid.

    This is one reason you never begin a letter saying 'I think I'm being paid when I shouldn't' - but 'I don't understand why I am eligible for this payment'.

    Wrong in the eyes of the law in that he has retained a wrongful credit.
