We will have to agree to disagree, section 71 of the SSA confirms that JCP are entitled to recover overpayments resulting from misrepresentation or non-disclosure on behalf of the claimant only.
If the OP did not misrepresent his position or fail to disclose a material fact (eg savings) then the money is not recoverable from him.
However if we were talking about HB then I would agree with you as the rules are different

if $10k of your money accidently got put into your neighbours bank account .... by youre thinking it would be ok for them to spend it even though they knew it wasnt theirs?

How does the OP know that they are not entitled to the money as the OP said the person in the J/C said you can get ESA and phi at the same time. I think that the op has done enough to let the ESA people know.0 -
the onus is on the claimant to ensure that they are receiving the correct benefit at the correct rate.
the OP has stated that they are not sure, and as such shouldnt spend it because it may not be theirs to spend!
if he can get a letter saying exactly what he has told them, and confirning that it his to spend ...
then that really would be their error and he would have the necessary proof to back it up0 -
I don't know if im entitled to ESA back in april when I got my lump sum I went into the J/C and told them they stopped all payments and we wrote a letter asking where we stand and to see if I was still entitled to any help. Last week i received a letter saying that my ESA claim would start from 15th august and would receive the money every fortnight.becaue the OP knows they arent entitled to the money!
