but sounds to me like you dont really have a case mate. I've been fined once for parking in the wrong spot. there were two bays one was free to park for resident, and the bay just next to it was pay to park. I missed my spot and parked in the wrongbay and got a 40 quid fine.
just to give you an idea 90% of excuses go along the lines of "i didn't know" or "i didn't see". the law doesn't require parking signs to be displayed in large neon signs that can been seen from the moon. It's the responsibility of the driver to get out and read the small parking notices on lamp posts, and also to check the road markings. It's unlikely you'll win the appeal. Talking of which appeal process is probably closed to you because you accepted their judgement by paying the fine

I have requested a copy of the contract between WELCOME BREAK and Parking Eye showing what proprietary interest they have in the land which enables them to offer any such contract in the first place.

They will not provide it, they are under no obligation to do so unless you (or rather your mother or father) takes them to court.
Your best bet (in fact your only bet) remains as you have been told: decide whether it's you father or mother making the claim, and have him/her send them a letter before action. Anything else is a waste of your time and energy.Je suis Charlie.0 -

Ive had some legal advice this afternoon from the young lady who took Parking Eye to court and won, and she is telling me that after the 14 days have expired after my mothers letter was sent, then to take them to the small claims court on the basis that the contract is between myself and scumbag parking company.
Anyway there is a very good website called www dot offmotorway dotcom for people who wish to avoid Welcome Break and such places who use Big brother technology and similar companies to Parking Eye!

But the point Tony is making is that HE didn't pay the charge,,,his mother did so although the charge has been paid (albeit by the wrong person) then could it be that the appeal process is still open to her?
I copped a penalty charge recently and thought im gonna have to pay this one(6 mins overstay on a P&D)but i appealed to the council stating my mitigation and they repealed the ticket...moral?ALLWAYS appeal,you never know,NEVER appeal to a parking charge...waste of stamp,time,email,
I have a beautiful picture where i was caught just recently on one of PEs anpr driving out of one of THEIR??????? car parks with two fingers up and when i find out how to then i will scan and post...thats what these scumbags get from me!
People at PENALTY appeals?...be nice to them they may well be nice back.
