Before any county court action you need to send a letter before action telling them what you want to avoid court action.
Send it to both Parking Spy and Moto stating any claim will be made against both of them.
Name yourself as the driver and request repayment to your father. Also £18 per hour for dealing with this crap.
I did it as a RK who was being pestered and got paid by the PPC for my time dealing with them.
It you need help with a letter give us a shout.

Thanks for that, i think i will quite enjoy this game with these parasites.
I actually am one of the few who manufactures things in the UK and around the world its mad that the govt does all it can to assist parasite companies and p7ss off the productive. But then again they fall into the former!0 -

I have now spoken to them and they have said that the matter is now closed as theyve received payment .... so what is the best way of going about this, is it a case of going to the small claims court going through HMC&TS' Money Claim Online or what is the best way forward from here.
Cheers Tony

The problem with using mcol is that the defendants have the option to use their local small claim court, so unless you are local to parking eye it will probably cost you considerably more to do this.
Personally I think you are onto a hiding to nothing, the money has gone learn from the mistake of them being paid. If you insist going forward despite everything post this on pepipoo they can offer advice as well.Excel Parking, MET Parking, Combined Parking Solutions, VP Parking Solutions, ANPR PC Ltd, & Roxburghe Debt Collectors. What do they all have in common?
They are all or have been suspended from accessing the DVLA database for gross misconduct!
Do you really need to ask what kind of people run parking companies?0 -

I'm pretty sure that where the claimant is a private individual and the defendant is a company then it gets transferred to the claimant's local court.
At least that's what happened last time I made a claim against a company. The defendant had filed a defence, but a cheque arrived in the post shortly after they realised where they would need to travel to.Je suis Charlie.0 -
But Taffy
If i had been speeding in the car and they fined my mother and she paid and accepted the points, then this would clearly be open to an appeal, when it became clear she wasn't the driver.
On the PCN website it states
If you were not the driver (or had sold/hired the vehicle) at the relevant time, and have not already done so, please provide us with the driver's full name and address so that we may transfer liability.
I am one of those people who just won't let these govt. and parasite organisations screw me over without a fight. To my detriment in many cases.
Id sooner spend a few hundred pound take time off work (im self employed) then just walk away.0 -

I have been providing assistance, including Lay Representation at Court hearings (current score: won 57, lost 14), to defendants in parking cases for over 5 years. I have an LLB (Hons) degree, and have a Graduate Diploma in Civil Litigation from CILEx. However, any advice given on these forums by me is NOT formal legal advice, and I accept no liability for its accuracy.0 -
Chris Huhne was blatant deceit intent on perverting the course of justice (allegedly)
