Watchdog - "selling alarms" cannot say one thing is free and dependent on purchasing something else LOL how ironic was that Orange !!!!??

Exactly - what they did and what they are doing now: move your line rental to us to keep your free broadband is one of the things they have said to me.

Just saw the same thing... Would that not make "free" handset offers illegal too? The mobile industry is mainly based on such offers, is it not?

Yes, technically anyone could take Orange to court for removal of free broadband & win on that, and add the FREE broadband & FREE mobile phone to the proceedings lol
SO... now England its the Scots turn to say dont leave the UK, stay in Europe with us in the UK, dont let the tories fool you like they did us with empty lies... You will be leaving the UK aswell as Europe ;)

Correct & no wonder you pay £5 now as a current Orange mobile customer.

Yes & why I told all to register a complaint against Orange through Ofcom, because they are not allowing this to happen. When Ofcom see's a high level of complaint on the same issue/s as licence issuer & regulator Ofcom can rule such on Orange how to proceed and also fine Orange.

Given Ofcom is mainly funded by fines, it likes large numbers of issues/complaints on the same matter ;)

  • am still waiting for a cut-off letter. no text or phone call.

either i'm below their radar or i'm far down the list...
  • They may be duty bound, but that doesn't mean that they will actually comply :( I spent over 3/4 hour being passed from pillar to post, with no-one able to actually comply with my request, before being promised a call back in a couple of hours or so...maybe the next day. That was ELEVEN DAYS ago.
Cue second letter of complaint, sent recorded delivery, giving final notice of impending court action - lets see what the courts say about this eh, if Orange cannot be bothered to say anything!
I had the same thing, and be calling the Information Commisisoners Office when off work on Friday.
ICO "If you need an urgent response to an enquiry please call our helpline on 0303 123 1113 or 01625 545745, which is available between 9am and 5pm, Monday to Friday."
This will definatley get a reaction from them.

I raised the unfair commercial practice influencing the decision to enter a contract and got the following reply from ofcom

From reading your complaint, I understand you are unhappy because Orange told you at the point of sale that the free broadband was for the duration of the entire contract. While I can understand your feelings about being mis-sold, all providers will reserve the right to vary their contracts. However, Ofcom regulations are in place for protecting consumers. If consumers are being notified of a change which is likely to cause them material detriment, the provider must, under Ofcom regulations, give them one month's notice of the change and inform them that they are entitled to terminate their contract without penalty if the change is not acceptable to them. We understand that Orange is allowing consumers to do this.

I am not a legal bod, does this mean we can terminate our mobile phone contracts?

OfCom are being deliberately obtuse on this matter, the problem has always been that Orange are insisting that the two contracts are not linked so we can't pull out of the mobile contract.
Our position is that one was the inducement for the other.

Ofcom have repeatedly ignored this issue.
You've done well to get even this from Ofcom as I have now written to them twice on the issue and even asked them about their own complaints procedure and been blanked both times.

    http://www.ofcom.org.uk/about/what-is-ofcom/

"Ofcom operates under the Communications Act 2003. This detailed Act of Parliament spells out exactly what Ofcom should do.

***The Act says that Ofcom’s general duties should be to further the interests of citizens and of consumers*** Meeting these two duties is at the heart of everything we do.

Accountable to Parliament, we are involved in advising and setting some of the more technical aspects of policy, implementing and enforcing the law. Independent of Government, our decisions and advice are not swayed by party politics, which allows us to act solely in the interest of citizens and consumers.

Accountable to Parliament, we are involved in advising and setting some of the more technical aspects of regulation, implementing and ***enforcing the law***"

But any telecoms licencee can break any UK law in its business & Ofcom do nothing to protect citizens or consumers...breaking the law is not a dispute for Alternative Dispute Resolution, they have no power to rule on such matters of law.

Complaints against Ofcom go here http://www.culture.gov.uk/about_us/our_ministers/9316.aspx they part fund Ofcom

  • My mother has just had the same letter.

We have both been Orange customers having contracts over about 6 years, with Free Broadband being part of said contract.

Now, not only was my mother conned into a 24 month contract (rather than 18 like mine) paying nearly three times more than I am a month, for less! - all because she went into a store and given the hard-sell for over an hour, four different sales assistants, in the end she said she felt like she couldn't leave without signing.

I tried to sort this out for her but they wouldn't budge, so we already had decided to leave Orange when our new contracts are up.

    Absolutely disgusting.

So now we have this as well, i've printed out the page where it shows the broadband as part of our bundles, please let me know if there is anything else worth doing at this point.

    Thankyou for any help
