CISAS do not need to comply with anything, they are only approved by Ofcom.

You use any adjudication scheme or lawyer you want to resolve any telecom dispute.

    Cisas is company owned by:

IDRS Ltd is incorporated in the UK, no. 5945499. Registered Office: 70 Fleet Street, London EC4Y 1EU

    Owned by http://www.google.co.uk/url?sa=t&rct=j&q=&esrc=s&source=web&cd=1&cad=rja&ved=0CCAQFjAA&url=http%3A%2F%2Fwww.cedr.com%2F&ei=H0SkUMWRMaqm0QWVoICgAw&usg=AFQjCNEDgvvIHPReyik6OAWuzhsQcbkWyA
SO... now England its the Scots turn to say dont leave the UK, stay in Europe with us in the UK, dont let the tories fool you like they did us with empty lies... You will be leaving the UK aswell as Europe ;)

CISAS is a private company not a statutory body, they can refuse ANY complaint against its "funders" - the Ofcom licensed telecoms companies.

If they are funded by the very same companies they are thought to "regulate" and if they do not have to comply with anything and anybody then WHY DO THEY EXIST? It defeats the purpose!

In terms of the 'for life' aspect, the problem is that historically the courts have generally viewed those sorts of claims as marketing fluff; it lacks sufficient substance in itself. There'd need to be some additional detail to suggest that they actually literally meant for the rest of the purchaser's natural life.

In terms of this offer, it was always a clear condition that it was whilst a qualifying mobile contract was held. A few years back, Orange's home broadband team did admit to me that weren't very good at monitoring whether a mobile contract was still held - that it wasn't automatic for the broadband to cease straight away.

I didn't cancel mine, so I can't verify that though.

However, it does mean that at the end of the mobile contract, Orange can easily dispense with the 'for life' broadband by refusing to permit it to be transferred to a new 'qualifying' mobile contract - just by using existing conditions that have been there from day 1.

So the most that can be insisted upon is the retention of the inclusive home broadband until the end of the fixed term of the current mobile contract.

Of course, further extensions could be requested, but you might not get!

Re: ... Orange can easily dispense with the 'for life' broadband by refusing to permit it to be transferred to a new 'qualifying' mobile contract - just by using existing conditions that have been there from day 1 ...
If they refuse to transfer doesnt this mean that they are still breaking the T&Cs.
    (2) had to be a min £30mth to qualify for the offer, (6) .. applied while remain on an eligible tariff ...
    In my case
    (2) definitely applied at the time
    (6) I dropped my rental below £20mth over a year ago and the "free broadband" remained, so under £20 is still eligible

If they raise a mobile contract by more than the agreed RPI/inflation rate they break T&Cs as proved in other disputes regarding 3g to 4g etc. If they do not offer an eligible contract then they also break the T&Cs ?

As still waiting for that letter of 'offer' confirmation from Orange I have emailed Orange, Ofcom and my MP. The next step will be my pre court letter

CISAS is an Ofcom approved Alternative Dispute Resolution body. Orange are required to arbitrate consumer complaints through an Ofcom approved ADR body.
If CISAS do not comply with the rules and act independently then they can be sanctioned by Ofcom.

CISAS is an Ofcom approved ADR scheme and not regulated by Ofcom.

Licensed Telecoms Service providers would be breaking consumer rules by not being a member of one of the two Ofcom approved ADR schemes.

    http://www.cisas.org.uk/
    http://www.ombudsman-services.org/communications.html

    Both are independent of Ofcom.

If Ofcom are able to direct them this sounds all very questionable

I'm quite happy. After contacting Orange on 0800 9801716, they have agreed to extend the free broadband until the end of the existing mobile contract, which is spring 2013.

Had a confirmation email to this effect.

When the contract is up, I'll go elsewhere, save a bundle on the mobile contract and be free from Orange forever!
    I'm a nutter :j

  • Hi All,

I am still here and reading the forum, well done to all who have achieved their `free` bb til end of current mobile contract. I think in reality that is the best we can hope for despite the promise of `free bb for life`.

    With reference to CISAS here are the emails between them and myself after my online complaint ;

    Dear Mr Me

    Rejection Reference No: 159**

Thank you for your recent application to the above scheme. Unfortunately we are unable to

help you in this matter as your complaint concerns a business decision taken by the

company you are complaining about. Business decisions fall outside the scope of our

scheme and we have no power to deal a complaint of this nature.

We suggest you contact your local Citizen’s Advice Bureau who may be able to advise you

    how to pursue your complaint.

We are sorry we cannot be of further assistance on this occasion.

    Yours sincerely.

    _________________________________________________

    I responded with :

    Hi,

I find this hard to believe, are you telling me that it was a business decision by Orange to `miss - sell` to me ?

    ___________________________________________________

    Dear Mr Me,

    Thank you for your e-mail.

In essence it is, which makes it a valid complaint but we are unable to deal with it because it is also a business decision that affect hundreds of Orange customers.

The fact that it is a business decision places it outside the remit of CISAS. We however suggest you seek independent legal advice in the matter.

While we understand your frustration, we trust the above clarifies matters.

    Kind regards,

    ________________________________________________

So it seems that even if we complain on the basis of being mis-sold to the response is the same.

This has already been posted but is lost in the past somewhere.

    Good Luck.......Nobby.

  • Dear M
    !
Thank you for your further email of 9 November 2012.
    !
In terms of me logging a case against Orange for mis-selling, this is for our monitoring purposes and we will not be contacting them about your individual complaint. However, we do log all complaints that we receive and if we see an increase in similar complaints about the same issue/provider, may look into this further. This is why it’s important that we log such complaints.
    !
I hope this explains our position.
    !
    Yours sincerely

Can we have a deluge please. All those that haven't please do.
All those that didn't, please reconsider. All those that are about to receive "The Letter",join in the fun.

I would like to commend EVA49 on her very eloquent letters, articulation of the facts, advice and last but not least motivation to help others on this forum (again many others as well, you know who you are.). I feel being part of this forum has thrown up many issues which relate to Orange’s dirty tricks/malpractice and OFCOM’s inability to give us information or indeed help of any sort. I myself was told to take legal action by Ofcom. Nice!! Given I pay well earned taxes for them to do this to me ,as they are part funded by us and clearly the rest by ORANGE/EE licences. (joke – in case this is presumed libellous!!!)This amounts to millions/billions of pounds especially for 4g. Doggy if you ask me!!:grouphug::grouphug::grouphug::grouphug:
Eva49 is a complete star and know’s the facts inside and out given the research she has undertaken, so anyone out there wanting to have a pop at EVA49 think again, unless you have researched it in a more thorough fashion, don’t even go there!!! :j:beer:
I myself received £100 compensation. Sorry not allowed to use that term. “Gesture of Goodwill” was how I was told it would be, most definitely not compensation. !!! Compensation is only what you receive if they have made an error!!!! (Obviously they will not admit this error/farce, but hey, we’re onto them big time!!) I was also informed I would NOT receive this in writing quite categorically but then how would they explain the £100 good will gesture.??? It is only the Executive Office that have the power to give any form of ”goodwill gesture”. My advice is to harass them daily and escalate the problem (08000790134) until they are totally sick of you, then you might get a result. It worked for me and if they decide to cut me off, God help them, it will be lawyers and a very prominent QC along with the press in court!!!!:mad::mad::mad::mad:
I have spoken to my local parliamentary candidate and hope that he is going to take all of these issues forward for me, along with my serious concerns regarding corruption, Ofcom, Orange mis-selling, lies, etc, etc ... the list goes on..:T:T:T:T:T:T:T:T:T:T:rotfl::rotfl::rotfl:and yes my BB continues untill 2014, when sadly I'll be leaving ORANGE - Not!!!

PS All calls I made to ORANGE and OFCOM I recorded on my phone and would make a great video on Youtube!!!! Lies,Lies and more lies!!!
