Really pleased to hear you have reached resolution to your satisfaction at last!

Even though not for 'life' - so long as you are happy with your negotiations, that is all that matters!

Thank you for mending the link in your bumped post! Appreciated.

    Well done nobby1963
But please remember there is quite a few of us out here still fighting on and could well need your help/advice (e.g. like EVA does in her posts)
    Kind Regards

I am not going anywhere - I want to see as many as possible get Orange to do their `U turn`.
They were quite happy to ignore us all when they thought we were just going to give in and move our landlines to them so now it`s our turn to give them some back !
    `They don`t like it up `em !` :D

Plusnet are doing well out of this lol, great service too!

Good Luck! can't believe they are letting it go this far and especially now they seem to have reversed their decision!
Yup, Plusnet surely are, and at £9.75 line rental paid up for a year, I have even managed a little moneysaving into the bargain - well I would have if I still had free BB :)

Papers received from the court in the post this morning - Orange are contesting the entire claim (thought they may offer to settle either the cost of alternative BB, or the cost of mobile termination, as a compromise, but no), so it looks like I will see them in court sometime. I have family (now retired) with considerable experience in small claims, and even criminal court cases, so the thought certainly doesn't bother me, and of course I can also claim travel and lost earnings, so if/when I win, Orange simply lose more :)

Now for a plea to other forumites - I have amassed over 40 pages of assorted evidence, but would love to be able to provide the court with evidence of Oranges backdown in similar cases, so if anyone on here has any correspondence that they would be happy to let me have a copy of, please PM me - I won't post on the forum without consent, but would hope to be able to produce in court to further bolster my case.

On the plus point, at least I have found one part of Orange that does respond to communication - the legal team :T This is the ONLY team that have actually contacted me and my wife since this whole sorry saga began  Maybe because we have asked for communication in writing (wife is deaf) or for a copy of the audio file of any discussions for me to transcribe for her, and we all know how keen Orange are to put things in writing :D

Thanks all - sorry for long post.

    Hi All,
Just doing some `surfing` on the subject of Orange ...came across this article ; http://www.broadbandchoices.co.uk/news/second-time-lucky-for-orange-free-broadband-280808.html

Seems to make a mockery of Orange saying as they did at the beginning of our arguements with them, that the `free` bb was only for the initial contracts when they first released it. As I see it the article is talking about them re-launching free bb.

Sorry guys, but I have started the process towards a court hearing with a final letter to Orange for breach of contract, so I am going to stick with it. I have one phonecall to make next week then I will fill out the paperwork and file after Nov 1st. They have had enough opportunities to sort this. Now its my turn to finish it.

The link makes interesting reading nobby.
It does not read very good in some paragraphs, about orange losing customers & which? don't buy.
I still have heard nothing fom exec office yet

Gadgetmaster - Although Orange have entered a defence to your claim, I would still be pro active and try to negotiate an out of court settlement.

I would try ringing both the legal team and Executive Office.

Assuming your claim is reasonable? I doubt Orange will actually attend your local Court for a hearing (could take you 2-3 mths to get court date).

It does appear Orange now seem more agreeable to resolution, considering that customers can now keep the free broadband!

It is however easy to argue both breach of contract because of mis sold mobile phone and being forced to move broadband because of duress / undue influence because of threat of disconnection.

Do Orange have a recording of your sales conversation for your mobile ? if they did, they would have a duty to disclose this to you.

Others have been offered penalty release from their mobile contract, but I assume you are claiming for both alternative broadband and mobile buy out, so your claim is high ?
Thanks Fitz, will give them one more call on Mon, as I have a couple of hours off work then.

I did ask for a copy of recordings (wasted nearly an hour being passed from pillar to post) before being btold that it was "unlikely" they would have a recording from 18 months ago.

Total claim was for just over £200, so not that high in the great scheme of things. My thoughts also are that they are unlikely to appear in court, although they do have a large office in Plymouth (my nearest town), so we shall see.

    Hi Jezster,
They were there earlier today but I expect they will be gone now.
If I were you I would call them on Monday if you are able, they are there until 8pm & there is of course the freephone number on EVA49`s what to do post.

I had to keep chasing them initially.

Orange do not seem conducive to acknowledging resolution in writing

I requested via email, that my penalty free release be put in writing, it was ignored.

However, I am sure the resolution conversation was recorded! Especially their request, and my subsequent agreement to drop legal action.

I did however receive a generic letter from the retentions team.

On the point of recordings of sales calls, when i spoke to the exec team yesterday the gentleman that i spoke to said that as my sale was in feb/march this year they wouldnt have a record of it.
