    Goodness Vesper, I can't believe you're going through that! :( It sounds ridiculous that they don't have any evidence against you (of course they won't, you didn't do it!), I can't see you going to jail if they can't prove anything and Claire's right, you want to be making comment about all the time the had you working unpaid! My ex-SIL *actually* stole thousands from her workplace and never went to jail, she got a suspended sentence and a fine I think, so don't lose hope. :)

    Is is Nicki who is/was a lawyer? Seem to remember something along those lines... maybe she can offer some advice? :)

    But Team lowe is correct - the onus is on them to prove you guilty not the other way around. And how can they do that if you didnt do it? Like you said evidence has apparently disappeared.

    Plus the police might be ignoring you but that doesnt mean the court will.

    Hopefully your work will be seen as a laughing stock if they try to use evidence which is lost or say you vandalised stuff when you werent even there.

    I dont know about anything legal except that the entire thing sounds ridiculous so hopefully it should too to any judge/jury or whatever you have to see.

    Plus - I hope this all is sorted out for you, and then you can get the company into trouble for breaking so many working time laws.

    The whole thing has been disgusting to the people from work barging into our house looking for me when they had been told I was in hospital. To one of them going into my husbands work and telling his boss that he had stollen loads of money and had been arrested so should be sacked, luckily hubby has nice boss that didn't believe a word of it. To accusing me of vandelising a vehicle with a huge metal pole which I could never lift never mind put it through a window thats above my head.
    To being arrested and not being allowd a responsible person with me (was at that time under the care of our local mental health unit and not trusted to be on my own, could barely function as a human being never mind answer questions), and being interviewed after having nothing to eat nor drink for over 24 hours.

    Its all a huge farce, I have got a solicitor but even he hasn't been allowed access to any evidence yet.
    I've had bits in my garden vandalised since then, people banging on my door as the place said I had took their money they had paid for an event (I wasn't even there that week, had been off ill).
    Been advised not to sue them as I could get myself into more trouble, but it irks me as this place never even paid me my holiday pay for the past year, mind you they never did for all the years I was there.
    Remember never judge someone that makes a mistake, because in six months time it may be you that makes the next mistake.

    They have got 'evidence' that the money they have in the bank is different to what they think they should have. But the accounts disappeared with a load of invoices that were paid out. So it will be different as they have recreated the accounts ignoring loads of invoices as they no longer excist.
    Remember never judge someone that makes a mistake, because in six months time it may be you that makes the next mistake.

    Vesper - did your work sack you because of the offences? Am just thinking that naybe you should be due some sort of compensation as well for all what they have put you through.

    My brother was unfairly dismissed and took his old company through tribunal. They made up absolute lies about him. He had been in the job 20 years. They ended up tying themselves in lies in front of the judge and were proved to have been lying, and they were told to agree to all financial compensation or face criminal charges for the lies they told under oath. He got a >>lot<< of money in the end.

    A forensic accountant should be able to trace the money though - there are paper trails and records with nearly everything like this. Cash is harder to trace - but not impossible. If its things through the bank - there are paper trails you can follow.

    I deal with accounts and tracing money to a certain extent - I'm a qualified accountant. I've never been involved in a fraud or a legal case tho.

    It might be that someone in the company has commited fraud - but how are they linking that 'evidence' to you?

    Sounds like you have been through such a horrible horrible time :( Wish I could come round with a cake n cheer you up (plus I wanna see yr ferrets on the treadmill cos the image still amuses me :p) xxx

  • Hi Ladies, sorry I've been MIA. Real life and ttc keeping me busy!

    Just read this page - so not sure what's happened Vesper - but big hugs. I cannot offer any practical advice, but we are all here to listen and offer emotional support sounds tough.

    Please can I be updated to CD15, 1DPO and put on the testing list for 12 February

    Used my CBFM this month and got a High reading on Thurs/Fri/Sat/Sun/Mon and then a Peak today. Pretty sure I OV'd yesterday afternoon/evening. And OH wasn't working last night, so had a hopefully well timed BD last night. I was praying not to have a Peak over the weekend as my mum and dad were staying and I just can't bd when they're there :rotfl:

    Off to read back now. Hoping there has been some BFPs!!

    Thanks for the info Tea, i was a bit on the fence about doing anything more as i don't have enough time for another cycle before clomid so might as well wait but if it affects weight loss then i'm all in. let's face it it can't make my stupid body worse! lol x x

  • Wow Vesper - just read back. Huge hugs xxx You are very brave posting, and I for one, certainly am not judging. There are some horrid employers out there, and it sounds as if you were unlucky to have one of the worst ones :( I'm no legal expert, but if they have "lost" important evidence, then it will do them harm. The jury will have to have seen enough evidence to deem you guilty beyond reasonable doubt. And hearsay and assumptions are not evidence. Definitely, sit down with your solicitor and make them aware of the poor character of your employers - ie no holiday, excessive hours, unreasonable conditions etc etc

    With regards to your health, please see your GP. Do you have a sympathetic GP who will listen and take your concerns seriously? Huge hugs lovely xxx

    Yeh they did that's why they barged into the house to give me the letter about my sacking. There reason for sacking was because I refused to talk to them about it... no I never refused, I was in hospital. So they said that as I wouldn't talk to them about it that day they would sack me and get me arrested. Since then they've told people that they want me locked up and will do anything to make sure I never work anywhere again and won't stop until my life is ruined.

    Oh also got accused of breaking in and steeling a till and possessions while I was in hospital.
    These people were my friends.

    as for the accounts they were cash purchases so no paper trail to the bank unforutantly. The accounts were accepted by the police as true even though if it was it would show that the place can't have bought any stock for a year.
    I was the accountant, so hence I get the blaim, even though the discrepancy is the missing invoices.
