Due a police visit - help

    I'm not quite understanding why the Op was arrested when he'd already voluntarily agreed to be questionned.

    Also, in a case like this where there's nothing to answer, what happens to the little git who made the false allegation? Does he get charged with wasting police time?

    It wouldn't be a civil case if there's a specific crime of wasting police time and criminal responsibility begins at age 10 in England/Wales so a case could most definitely be brought.

    ETA: It looks like it is a specific crime:

    In England and Wales, one can be charged with the offence under Section 5(2) of the Criminal Law Act 1967[1] when one "causes any wasteful employment of the police" by "knowingly making to any person a false report" which:
    • Shows that a criminal offence has been committed,
    • Creates apprehension for the safety of any persons or property, or
    • Indicates that they have information material to any police inquiry.
    The offence carries a maximum penalty of six months' imprisonment and/or a fine.

    Given that, I wonder if the Op could make a formal complaint to the police against this kid of 'knowingly making a false report'. I'd certainly give it a shot, otherwise the kid will never learn and feel free to try and get people into legal !!!!!! again.

  • No, I meant from the point of view of the falsely accused. I very much doubt the police will do anything, even if a complaint is made to them about original complainant.

    Not in the case I was involved in. The child had done this three times before and despite incontrovertible proof that she had lied, she got away scott free. Well, as scott free as having your entire family publicly humiliated and being forced to leave the area.

    So in one way, at least British police are seen as being preferable to the rest of the continent...!

    It used to be amusing, but these days it is not. Judged solely on the police, I think I would rather be in Hell with German police than in Heaven with British police

    That was confusing me also. I should think that either the OP didn't want to come along, so they arrested him. Or the police officer wasn't following correct procedure.

    I would hope that the bully was charged with wasting police time.

    With an overworked, and under funded police force, it would be nice to think that they were punished in some way.
