Hi, Jo here (Director of AdsOnCars)

Thanks for all the points you have raised above. Below are responses which, I hope, will put your mind at rest. (There is so much to say that I will have to post these answers in two sections)

What happens if I sell my car within the 5 year term? Why the 5 year term?

If you sell your car within the 5 year term, just let us know (csdrivers@adsoncars.com) or amend your own details using your unique username and password. It is the driver, not the car that is signed up for 5 years. If you are not intending to get a new car, let us know. Your name will remain on our database for 5 years (as the deletion/renewal process is automated) but there will be a note made on your record that you no longer have a vehicle. At this juncture I must point out that your details are not sent or sold to any third party other than the advertisers for selection.

We need to be able to offer our advertisers a stable database of quality carefully selected drivers, hence the 5 year agreement. If you meet our selection criteria our clients want to be able to come back to you, we naturally need to offer long-term security to both parties. However, registrants can refuse participation in a programme at the time the offer is made without any ramifications.
In others words if you don’t want to participate you simply do not accept any offers.
Once you begin to receive all the benefits that AdsOnCars can bring we are sure you will not want to turn the campaigns (money) down.
In summary it is basically good business practice. AdsOnCars is pioneering a new market, we need to have the security of a stable database. As we continue our growth we would be potentially put at risk from new entrants to the market if our entire database of drivers could disappear overnight. Our advertisers, financial backers and the bank need this security.

Since each company demands you stick only with them (for 5 years!), how do we choose the one most likely to find us a suitable sponsor and make us money?

Difficult one to answer - and of course no company can guarantee selection of any driver (although, as I have said previously, any registered driver without an ad on their car is a wasted resource as far as we are concerned!). Obviously I can only speak for AdsOnCars, but we already have (confidential) agreements with some, and are in advanced negotiations with other, high profile brands throughout the UK. These brands are now incorporating vehicle advertising as a new but important part of their total marketing strategies for 2004.
Drivers are selected according to the criteria requested by the advertiser, within that selection they are presented in date order. Therefore the sooner you are registered the greater your chances.
We repeat though nothing is guaranteed, and remember it currently costs you nothing to register.
We have investigated the possibility of individuals opting out of the 5 year contract, all drivers would be free to advertisers to select, however all those who had not opted out would be placed above them in priority. We have not introduced this as the feedback from the vast majority of drivers has been very positive and they can see the need for our service having a long term database.

".....Perhaps Jo can clarify what, in practical terms, this clause aims to cover (I have already emailed this question to adsoncars, but as yet have not received an reply)" (posted by Alison Kopieczek)

First of all let me apologise for you not receiving a reply to your email question - we are sticklers in our quest to answer every email we receive. I have trawled through the enquiries and cannot find any that have not been replied to or any referring to the point you made above so I can only assume it has bee lost in the 'ether' somewhere. Again, apologies.

In answer to your questions - as far as trade marks/copyright issues are concerned - the design and wrap either comes direct from the advertiser or is agreed/signed off by the advertiser - so any dispute arising from those points would be referred straight back to the advertiser. For damage to the vehicle during application/removal of the display, see clause 7.2.1 "... any damage to the Car resulting from installation, use or removal of the Display shall first be compensated pursuant to the warranty of the display manufacturer as provided at the time of installation." This means that the wrap manufacturers warranty will cover any damage made during these processes. We check these and will only use manufacturers whose warranties are sound and reasonable, we use 3M, Avery Dennison film which are of the highest quality with appropriate warranties. You must remember that Drivers are valuable to us (they are our primary resource after all) - we will therefore look after them! Look at it this way - if you sold advertising space on a big billboard on Oxford Street... would you repaint it when necessary; keep it clean and make it attractive to the advertisers who want to show their brand off to its best, or would you let it get chipped and mucky and eventually let it fall down? Now I'm not calling you all billboards, but I hope you get my point!

"What happens if the company goes bust? But how the heck do you get the advertising stuff off your car? Is it a special process? What would it cost in time and money?"

Yes, it is a special process but we guarantee (and are insured) to take it off once put on. So if we went bust you would be ok regarding removal of ad. We are pleased to say that our financial backers, the banks and our advertising clients consider this to be an unlikely scenario

"Careful guys, I drive a black cab in Manchester and I have seen some of the horrendous damage that is done to the paint work when these ads come off. Be warned!
    Mike Daniels"

    Mike, that's very interesting.

I would imagine any advertiser or arranger of the advertising on the vehicles doesn't entertain any claims for damage as they probably have some sort of disclaimer/limited liability/opt-out clause?

The vehicle is thoroughly checked before application and the condition agreed with the driver. If a car is in good condition prior to an ad placement and if (in the unlikely event) the ad caused any damage we guarantee any valid claim would be put right. We simply state that as the base material is supplied to us under warranty we seek redress first from the manufacturer, anything else would invalidate the warranty.

The material used is of the highest quality supplied by world leaders in this technology (eg 3M) with many years experience. AdsOnCars' applicators have also wrapped hundreds of vehicles. As stated previously the vinyl will not damage your car, if it did it cause damage we would put it right. We are happy to supply all selected drivers with technical specifications and warranties for the materials used if they wish.
You are indeed correct in one respect, if an old car with poor quality or damaged paintwork is used there would be a good chance that, when the vinyl is removed, the adhesion to the vinyl would be stronger than the adhesion to the old / damaged paintwork. This would be highlighted to any driver whose car was in such a condition and they would have to do their own cost / benefit analysis of doing a campaign, if they were selected. NB We do ask drivers to indicate the condition of the vehicle upon registration. The majority (but not all) of advertisers are looking for vehicles that are fairly new and are in good condition.

    Any more questions, please ask!

    Jo

I agree with Alan, I wonder whether Jo can let us know of happy customers - perhaps they can post something on this message board.
  • Still a lot of doubters, but that is understandable I think.

Does anybody know what the exact situation is with regard to insurance (whether your vehicle displays advertisements for your business or somebody else's)?

I apologise in advance for being pedantic, but I would guess insurers would state that any vehicle displaying advertising becomes a commercial/business vehicle and therefore adequate business insurance would be due complete with ridiculous premiums, etc. that come with them (I have had experience).

Now for the pedantic bit: if this is so (and I'm sure all of us would expect it to be so), how is it that any reference to any organisation offering a product or service already displayed on your vehicle is not generally considered to be an advertisement?

I'm specifically thinking of road fund licence holders, breakdown badges, stickers and window graphics, garage/supplier graphics, number plate wording (not the registration), spare wheel cover ads, those extra ads you see now and again applied by garages to the body work of cars (esp. tailgates) and so on.

Pedantic maybe, but I would be surprised if double standards would not be at play here - and this issue is very important and needs addressing with relation to this topic and in general.

Any knowledgeable insurance professionals out there that would like to pass comment on this?

For insurance purposes: When is and ad on a vehicle an ad and when is it not? ???

    ;)Mark E
No reliance should be placed on the above.

ditto above... Yes i too signed up a while ago and have heard nothing. I am beginning to wonder whether the whole thing is a scam! Remember how lengthy the registration procedure was? Could it be that this was just a subtle way of gathering lots of information about us and our cars? Waiting to hear from you, Jo. Are there any happy customers out there?
