The bailiff's may be your only option. Go through MCOL and issue a warrant of execution, although I would wait until 14 days from the day of judgment have passed.
The warrant will get sent to the court nearest the address against which you have claimed. You will then find out 1, how far the bank is willing to hold out or 2, you cocked up the claim in the first place e.g had the wrong name on the claim form0 -
Can anyone tell me what to do now. I've done everything on line and not had very much correspondence from the court or the Halifax.
I'm as far as: 'Judgment issued' 25th May 2007. The next step it's telling me is: Warrant. What do I do now, I've not recieved anything at all from the Halifax, they owe me £2700 now with all the interest and court charges. Also I've got a further £55. to pay for the Warrant, can anyone explain what this all means please, I've never heard Martin speak of a Warrant before. X0 -
I have gone through all the protocols and ended up sending Halifax to Court via MCOL for just under £3k.
They didnt contact me or acknowledge MCOL or file a defence so today I have applied for Judgement by Default.
Does anyone know how it works from here??
I am going away on 20th June for over a month and MCOL tell me that I can send the Baliffs in at any time once the Judgement has been granted. If Halifax dont pay me or contact me I will be doing this before 15th June.
If this happens anyone got any press contacts, advice on how to do it etc??
Also I was going to send them to Head Office in Leeds....any advice on this??
Hope to hear from someone soon!!0 -

George can you tell me what address you put on the Court claim form as when I spoke to MCOL they said that if I wanted to send Baliffs in I needed a NON PO Box address and the one that I used on the claim was the Po Box address in Leeds.0 -

Beardface
If we cocked up the form is this a way for them to get out of it?? How might this have been done as I thought MCOL checked everything before issuing the claim??
If one has cocked it up what happens then??
Just worried as seems strange that they didnt acknowledge my claim as others seem to being acknowledged.
Any help much appreciated.0 -
So posted this earlier:
'Hi, need to find out what happens next, have done all the normal stuff and lloyds had entered an ackowledgment to the summons i did via mcol on the 26/4/07. Went back to mcol on the 30/5 and still no defence was entered by the bank so clicked on enter judgment and today recieved letter from court saying judgment has been entered. do i just sit and wait now?'
So i have been told to ask how to get the money out of lloyds, do i issue a warrant now or contact them? what number shall i call?
The judgement total is £10605.00 and the solicitor who was delaing with this is foot anstey, who will not return any calls or emails.0 -

I have had to go down the warrant route as Shop Direct Financial Services (Choice for You catalogue) still havent paid up ten days after submitting the judgement as they didnt defend the case.
Just wondering what happens now and how long till I get my money??0 -

I didnt realise this thread existed so looking at all the replies looks like I am in for a long wait!! Was hoping it would be quite quick as was hoping I could get my £55 back sharpish. :mad:0 -
Hi all! I am over the moon ! just been awarded all my money back from HSBC My only question now is, how long is at reasonable to give the bank to cough up before sending in bailiffs. I only won last week but better to be prepared. Cheers and thanks for all the help over the last few months you are all wonderful! :beer:0
