hi guys,
i really hope someone can help me. i made against halifax, and was awarded a 'judgement by default.' However during the initial onlinee application i made a mistake so the case was undertaken by northampton court rather than mcol. now however i don't know how to issue a warrant because the claim was not processed by mcol. Can anybody tell me how to issue a warrant without using mcol.
Thanks Steve0 -

Hi, Hopefully someone can help me.
A work colleague 'bought' a marine fish tank off me but on the night they collected it, after the tank was all dismantled, they told me they couldn't pay me until pay day. To cut a long story short, it was not possible to put the fish back and wait until they had the money. I had to go on trust that they would pay me. They DIDN'T!!
After many attempts to get them to pay I eventually raised a case on MoneyClaimOnline. My case was upheld and a Bailiff's warrant was issued.
A warrant was issued in November 2007. I received letters stating the Bailiff had tried to execute the warrant but nobody was in. MCOL did not contact me to tell me the Bailiff, having tried many times to execute the warrant, had decided the person had been in hospital and was now out of work so didn't have the ability to pay therefore they were not going to fulfill the warrant. I didn't know this decision until I contacted MCOL after the 1 year was past. I was then told I would have to pay a further fee to re-issue the warrant.
I can't believe it. Somebody can walk into your house, take your goods knowing they can't afford to pay for them, refuse to pay, then you are forced to pay out in excess of £100 to take them to the small claims court only to find that even though your case is upheld and a warrant issued, they can then claim they can't afford to pay, and the aggrieved person has to pay more money to the court with no guarantee that this time the Bailiff will actually fulfill the warrant. I could pay a further £50+ only to find that they choose not to fulfill the warrant again!!!
1) - Have I any recourse to MoneyClaimOnline who failed to tell me they'd ceased to chase the money.
2) - Do I have any guarantee that this warrant will be fulfilled if I pay to have it re-issued?
3) - Is there anything else I can do?
Could someone please help?
Thanks - hopefully yours - ElleGBee0
